The Senate Committee on Appropriations offered the following
substitute to HB 611:
A BILL TO BE ENTITLED
AN ACT
To amend Part 1 of Article 4 of Chapter 12 of Title 45 of the Official Code of Georgia1
Annotated, relating to management of budgetary and financial affairs, so as to provide for2
the disposition of state funds paid to the state from certain legal judgments or settlements;3
to provide for related matters; to provide for an effective date; to repeal conflicting laws; and4
for other purposes.5
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
SECTION 1.7
Part 1 of Article 4 of Chapter 12 of Title 45 of the Official Code of Georgia Annotated,8
relating to management of budgetary and financial affairs, is amended by adding a new Code9
Section to read as follows:10
"45-12-76.1.11
All funds paid to this state from legal judgments awarded to this state on or after June 1,12
2023, or legal settlements entered into by this state or on its behalf on or after June 1, 2023,13
shall be held in the state treasury until appropriated by the General Assembly. Such14
appropriations shall be made in accordance with any terms or conditions required of such15 23 LC 43 2814S

judgments, settlements, or memoranda of understanding, if any, provided that such terms16
or conditions are not otherwise prohibited by state or federal law."17
SECTION 2.18
This Act shall become effective on June 1, 2023.19
SECTION 3.20
All laws and parts of laws in conflict with this Act are repealed.21
