A BILL TO BE ENTITLED
AN ACT
To amend Code Section 47-23-21 of the Official Code of Georgia Annotated, relating to

authority of the board for the Georgia Judicial Retirement System, so as to provide that2
postretirement benefit adjustments shall be issued to members who became members on or3
after July 1, 2009, in the same manner as other members; to provide for adjustments based4
on prior years; to provide for related matters; to provide conditions for an effective date and5
automatic repeal; to repeal conflicting laws; and for other purposes.6
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7
SECTION 1.8
Code Section 47-23-21 of the Official Code of Georgia Annotated, relating to authority of9
the board for the Georgia Judicial Retirement System, is amended by revising subsection (e)10
as follows:11
"(e)  Notwithstanding the provisions of subsection (d) of this Code section, no

member who becomes a member of this retirement system on or after July 1, 2009, shall13
be entitled to receive any the same postretirement benefit adjustment adjustments provided14
to other members of this retirement system, including those granted on or after July 1, 201915
to the members who were retired at such time, but did not receive such adjustments."16 23 LC 43 2747

SECTION 2.

This Act shall become effective on July 1, 2024, only if it is determined to have been18
concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia19
Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not20
become effective and shall be automatically repealed in its entirety on July 1, 2024, as21
required by subsection (a) of Code Section 47-20-50.22
SECTION 3.23
All laws and parts of laws in conflict with this Act are repealed.24
