1717 To amend Part 3 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia

1919 Annotated, relating to health, so as to require automated external defibrillators in all schools;2
2020 to provide for definitions; to provide for the establishment of emergency action plans to3
2121 address a person in cardiac arrest; to provide for internal response teams; to provide for4
2222 practice drills; to provide for related matters; to repeal conflicting laws; and for other5
2323 purposes.6
2424 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7

2626 Part 3 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated,9
2727 relating to health, is amended by revising Code Section 20-2-775, relating to automated10
2828 external defibrillators required in high schools, requirements, and funding, as follows:11
2929 "20-2-775.12
3030 (a) As used in this Code section, the term:

3232 (1) 'Automated 'automated external defibrillator' means a defibrillator which:14
3333 (1)(A) Is capable of cardiac rhythm analysis;15

3636 (2)(B) Will charge and be capable of being activated to deliver a countershock after16
3737 electrically detecting the presence of certain cardiac dysrhythmias; and17
3838 (3)(C) Is capable of continuously recording cardiac dysrhythmia at the scene with a18
3939 mechanism for transfer and storage or for printing for review subsequent to use.19
4040 (2) 'Emergency action plan' means the plan established pursuant to paragraph (5) of20
4141 subsection (c) of this Code section to provide for an emergency response to a person in21
4242 cardiac arrest.22
4343 (3) 'Internal response team' means the team of school personnel established pursuant to23
4444 paragraph (7) of subsection (c) of this Code section responsible for oversight of an24
4545 emergency response to a person in cardiac arrest and implementation of the emergency25
4646 action plan.26
4747 (4) 'School' means a public school in this state which provides K-12 education.27
4848 (b) No later than July 1, 2008 2025, each public high school in this state which has an28
4949 interscholastic athletics program shall have at least one functional automated external29
5050 defibrillator on site at such school at all times and easily accessible during all school hours30
5151 and during any school related function, including athletic practices, athletic competitions,31
5252 and other occasions where students and others will be present, for use during emergencies.32
5353 (c) Each high school possessing and maintaining an automated external defibrillator shall:33
5454 (1) Ensure that each member of the internal response team and any other expected users34
5555 of the automated external defibrillator receive American Heart Association or American35
5656 Red Cross training in cardiopulmonary resuscitation and automated external defibrillator36
5757 use or complete an equivalent nationally recognized course;37
5858 (2) Notify the appropriate emergency medical services system of the existence and38
5959 location of the each automated external defibrillator prior to said automated external39
6060 defibrillator being placed in use;40
6161 (3) Ensure that the automated external defibrillator is maintained and tested according41
6262 to the manufacturer's operational guidelines;42

6565 (4) Ensure that there is involvement of a licensed physician or other person authorized

6767 by the Georgia Composite Medical Board in the site's automated external defibrillator44
6868 program to ensure compliance with requirements for training, notification, and45
6969 maintenance; and

7171 (5) Establish a written emergency action plan that adheres to nationally recognized47
7272 standards and that establishes specific steps to take during a cardiac emergency in a48
7373 school setting. Such plan shall be designed to provide for an effective system for49
7474 communication between members of the internal response team and other school50
7575 officials, ensuring Ensure that the internal response team or other designated personnel51
7676 activate the emergency medical services system as soon as reasonably possible after any52
7777 person renders emergency care or treatment to a person in cardiac arrest by using an53
7878 automated external defibrillator and reports report any clinical use of the automated54
7979 external defibrillator to the licensed physician or other person authorized by the Georgia55
8080 Composite Medical Board who is supervising the program., and ensuring that emergency56
8181 medical services personnel are led directly to the exact location of the person in cardiac57
8282 arrest;58
8383 (6) Beginning in the 2025-2026 school year and each school year thereafter, conduct a59
8484 minimum of two emergency action plan practice drills per school year, with at least one60
8585 per semester. One such practice drill may be a tabletop drill to walk through a61
8686 hypothetical scenario and the courses of action a school will need to take before, during,62
8787 and after a cardiac emergency. The emergency action plan practice drills shall include63
8888 various locations on school grounds and responses to different hypothetical situations;64
8989 (7) Establish a designated internal response team composed of:65
9090 (A) At least five school staff members;66
9191 (B) One or more designated team leads trained in cardiopulmonary resuscitation and67
9292 automated external defibrillator use and responsible for oversight of an emergency68
9393 response;69

9696 (C) One or more designated cardiopulmonary resuscitation leads trained in70
9797 cardiopulmonary resuscitation and automated external defibrillator use;71
9898 (D) One or more designated automated external defibrillator leads, responsible for72
9999 knowing the location of automated external defibrillators, retrieving automated external73
100100 defibrillators, and maintenance of automated external defibrillators; and74
101101 (E) One or more designated communication leads responsible for activating the75
102102 emergency medical services system, facilitating directions to the person in cardiac76
103103 arrest for emergency medical services personnel upon arrival at the school, and77
104104 coordinating communications with the designated team lead or leads; and78
105105 (8) Apprise all school personnel of the location of automated external defibrillators and79
106106 the members of the internal response team.80
107107 (d) Subject to appropriations by the General Assembly, the Department of Education shall81
108108 provide funds to local school systems to assist in the purchase of automated external82
109109 defibrillators pursuant to this Code section.83
110110 (e) The department and local school systems shall use diligent efforts to identify private84
111111 sources of funding or donation of funding and equipment to meet the requirements of this85
112112 Code section."86
113113 SECTION 2.87
114114 All laws and parts of laws in conflict with this Act are repealed.88
