1010 To amend Code Section 31-12A-2 of the Official Code of Georgia Annotated, relating to

1212 definitions regarding smoke-free air, so as to revise definitions; to provide for related2
1313 matters; to repeal conflicting laws; and for other purposes.3
1414 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:4
1515 SECTION 1.5
1616 Code Section 31-12A-2 of the Official Code of Georgia Annotated, relating to definitions6
1717 regarding smoke-free air, is amended by revising paragraph (16) and adding a new paragraph7
1818 to read as follows:8
1919 "(16) 'Smoking' means inhaling, exhaling, burning, or carrying any lighted tobacco9
2020 product intended for inhalation,
2121 including cigarettes, cigars, and pipe tobacco. Such term10
2222 includes the use of an electronic smoking device which creates an aerosol or vapor or the11
2323 use of any oral smoking device for the purpose of circumventing the prohibition of12
2424 smoking in this chapter."13
2525 "(19) 'Tobacco product' has the same meaning as in 21 U.S.C. Section 321(rr) as it exists14
2626 on July 1, 2023."15
2727 SECTION 2.16
2828 All laws and parts of laws in conflict with this Act are repealed.17
