77 To amend Article 3 of Chapter 5 of Title 16 of the Official Code of Georgia Annotated,

99 relating to kidnapping, false imprisonment, and related offenses, so as to provide for a2
1010 required human trafficking training program for hotels; to provide for definitions; to provide3
1111 for retraining; to provide for related matters; to repeal conflicting laws; and for other4
1212 purposes.5
1313 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
1414 SECTION 1.7
1515 Article 3 of Chapter 5 of Title 16 of the Official Code of Georgia Annotated, relating to8
1616 kidnapping, false imprisonment, and related offenses, is amended by adding a new Code9
1717 section to read as follows:10
1818 "16-5-48.

2020 (a) As used in this Code section, the term:12
2121 (1) 'Employee' means any person employed by a hotel that:13
2222 (A) Has frequent or regular interactions with guests, such as front desk staff, hotel14
2323 porters, hotel concierges, restaurant waiting and bartending staff, room service staff,15
2424 and temporary employees;16
2525 (B) Is in a management position; or17

2828 (C) Has access to the guests' rooms, including housekeeping staff.18
2929 (2) 'Hotel' shall have the same meaning as defined in Code Section 16-5-47.19
3030 (b) Every hotel proprietor shall require its employees to complete a training course on20
3131 recognizing and reporting instances of suspected human trafficking. Such training course21
3232 shall be an online course provided by the Criminal Justice Coordinating Council at no cost22
3333 to the hotel proprietor nor employees or an alternative online or in-person training course23
3434 approved by the Georgia Bureau of Investigation. The Criminal Justice Coordinating24
3535 Council shall approve or deny the use of any alternative online or in-person training course25
3636 within 60 days of the submission of such training course for approval.26
3737 (c) Each hotel employee shall complete the required training course described in27
3838 subsection (b) of this Code section within six months of being employed by a hotel and28
3939 thereafter at least once during each consecutive period of two calendar years, commencing29
4040 with the date on which he or she last completed the required training course, for as long as30
4141 he or she is employed by a hotel."31

4343 All laws and parts of laws in conflict with this Act are repealed.33
