25 | 25 | | Chapter 3 of Title 33 of the Official Code of Georgia Annotated, relating to authorization and8 |

26 | 26 | | general requirements for transaction of insurance, is amended by adding a new Code section9 |
---|
27 | 27 | | to read as follows:10 |

28 | 28 | | "33-3-28.1. |

30 | 30 | | (a) As used in this Code section, the term:12 |
---|
31 | 31 | | (1) 'Benefit provider' means any insurer, health maintenance organization, health benefit13 |
---|
32 | 32 | | plan, preferred provider organization, employee benefit plan, or other entity which14 |
---|
33 | 33 | | provides for payment or reimbursement of healthcare expenses, healthcare services,15 |
---|

36 | 36 | | disability payments, lost wage payments, or any other benefits under a policy of16 |
---|
37 | 37 | | insurance or contract with an individual or group.17 |
---|
38 | 38 | | (2) 'Injured party' means a person who alleges that he or she has been injured by the acts18 |
---|
39 | 39 | | or omissions of a third party and who has received payments or reimbursements from a19 |
---|
40 | 40 | | benefit provider. Such term also includes the personal representative of the estate of such20 |
---|
41 | 41 | | person.21 |
---|
42 | 42 | | (3) 'Treating healthcare provider' means a person duly licensed or legally authorized to22 |
---|
43 | 43 | | provide healthcare services in this state and who has provided such services to an injured23 |
---|
44 | 44 | | party.24 |
---|
45 | 45 | | (b) Within 30 days of a written request from a treating healthcare provider, a benefit25 |
---|
46 | 46 | | provider shall provide to such treating healthcare provider a written accounting of any and26 |
---|
47 | 47 | | all payments and reimbursements made to an injured party for such treating healthcare27 |
---|
48 | 48 | | provider's healthcare services to such injured party."28 |
---|
49 | 49 | | SECTION 2.29 |
---|
50 | 50 | | This Act shall become effective upon its approval by the Governor or upon its becoming law30 |
---|
51 | 51 | | without such approval.31 |
---|

53 | 53 | | All laws and parts of laws in conflict with this Act are repealed.33 |
