1515 A BILL TO BE ENTITLED
1616 AN ACT
1717 To amend Chapter 3 of Title 33 of the Official Code of Georgia Annotated, relating to

1919 authorization and general requirements for transaction of insurance, so as to provide for a2
2020 benefit provider to disclose certain payments to a treating healthcare provider; to provide for3
2121 definitions; to provide for related matters; to provide for an effective date; to repeal4
2222 conflicting laws; and for other purposes.5
2323 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
2424 SECTION 1.7
2525 Chapter 3 of Title 33 of the Official Code of Georgia Annotated, relating to authorization and8
2626 general requirements for transaction of insurance, is amended by adding a new Code section9
2727 to read as follows:10
2828 "33-3-28.1.

3030 (a) As used in this Code section, the term:12
3131 (1) 'Benefit provider' means any insurer, health maintenance organization, health benefit13
3232 plan, preferred provider organization, employee benefit plan, or other entity which14
3333 provides for payment or reimbursement of healthcare expenses, healthcare services,15

3636 disability payments, lost wage payments, or any other benefits under a policy of16
3737 insurance or contract with an individual or group.17
3838 (2) 'Injured party' means a person who alleges that he or she has been injured by the acts18
3939 or omissions of a third party and who has received payments or reimbursements from a19
4040 benefit provider. Such term also includes the personal representative of the estate of such20
4141 person.21
4242 (3) 'Treating healthcare provider' means a person duly licensed or legally authorized to22
4343 provide healthcare services in this state and who has provided such services to an injured23
4444 party.24
4545 (b) Within 30 days of a written request from a treating healthcare provider, a benefit25
4646 provider shall provide to such treating healthcare provider a written accounting of any and26
4747 all payments and reimbursements made to an injured party for such treating healthcare27
4848 provider's healthcare services to such injured party."28
4949 SECTION 2.29
5050 This Act shall become effective upon its approval by the Governor or upon its becoming law30
5151 without such approval.31
5252 SECTION 3.32
5353 All laws and parts of laws in conflict with this Act are repealed.33
