25 LC 57 0199 House Bill 181 By: Representatives Ehrhart of the 36 th , Camp of the 135 th , Hilton of the 48 th , Donatucci of the 105 th , and Silcox of the 53 rd A BILL TO BE ENTITLED AN ACT To amend Chapter 10 of Title 31 of the Official Code of Georgia Annotated, relating to vital 1 records, so as to provide for the issuance of a "Certificate of Foreign Birth" by the state2 registrar without a judicial order if certain criteria is satisfied; to provide for necessary forms;3 to provide for related matters; to repeal conflicting laws; and for other purposes.4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:5 SECTION 1.6 Chapter 10 of Title 31 of the Official Code of Georgia Annotated, relating to vital records,7 is amended by adding a new Code section to read as follows:8 "31-10-13.3. 9 (a) A child who has automatically acquired United States citizenship following a foreign10 adoption and who possesses a Certificate of Citizenship in accordance with the federal11 Child Citizenship Act of 2000, P. L. 106-395, 114 Stat. 1631, shall be exempt from the12 provisions of Code Section 31-10-13, requiring a report of adoption from a court of13 competent jurisdiction in this state to acquire a 'Certificate of Foreign Birth.'14 (b) The state registrar, upon written request, shall prepare a 'Certificate of Foreign Birth'15 reflecting the actual date and place of birth for a child who was born in a foreign country,16 H. B. 181 - 1 - 25 LC 57 0199 was adopted by a United States citizen, and has automatically acquired citizenship in17 accordance with the federal Child Citizenship Act of 2000 upon the production of the18 following documents:19 (1) The child's Certificate of Citizenship;20 (2) A certified copy of the child's foreign birth certificate and a certified English21 translation;22 (3) The original documents related to the foreign adoption certified by the United States23 Embassy abroad and a certified English translation;24 (4) The social security card of the child;25 (5) A valid government issued form of identification possessing a picture of the parent26 or parents, such as a passport or driver's license; and27 (6) Proof of residency of the parent or parents in the State of Georgia.28 (c) The state registrar shall develop any necessary forms for adoptive parents to submit in29 order to request a 'Certificate of Foreign Birth.'"30 SECTION 2.31 All laws and parts of laws in conflict with this Act are repealed.32 H.
