1515 A BILL TO BE ENTITLED
1616 AN ACT
1717 To amend Title 40 of the Official Code of Georgia Annotated, relating to motor vehicles and

1919 traffic, so as to require the placement of a special identifying sticker on the windshields of2
2020 alternative fueled vehicles; to provide for the design and distribution of such stickers by the3
2121 Department of Revenue; to provide for the designation of a vehicle as an alternative fueled4
2222 vehicle on a motor vehicle registration application; to provide for a penalty; to provide for5
2323 exceptions; to provide for definitions; to provide for legislative findings and purpose; to6
2424 provide for related matters; to provide for an effective date; to repeal conflicting laws; and7
2525 for other purposes.8
2626 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:9
2727 SECTION 1.10
2828 The General Assembly recognizes that the number of alternative fueled vehicles operating11
2929 on Georgia's highways continues to grow. Alternative fueled vehicles pose a unique12
3030 challenge to first responders, as different types of fuel can require specific safety procedures13
3131 in instances of an accident. Many alternative fueled vehicles are indistinguishable from14
3232 traditional gasoline powered vehicles. Requiring a special sticker to identify a vehicle as an15
3333 alternative vehicle and what type of fuel is used would assist first responders in quickly16

3636 determining the appropriate response measures to be taken after an accident. Such stickers

3838 are necessary for the safety of first responders and the general public.18
3939 SECTION 2.19
4040 Title 40 of the Official Code of Georgia Annotated, relating to motor vehicles and traffic, is20
4141 amended by adding a new Code section to read as follows:21
4242 "40-1-10.

4444 (a) As used in this Code section, the term:23
4545 (1) 'Alternative fueled vehicle' means a motor vehicle with a gross weight of 10,00024
4646 pounds or less fueled exclusively or partially by electricity, natural gas, hydrogen, or25
4747 propane.26
4848 (2) 'Alternative fueled vehicle sticker' means a sticker approved and provided by the27
4949 department designating a motor vehicle as an alternative fueled vehicle.28
5050 (3) 'Department' means the Department of Revenue.29
5151 (b) Upon approval of an application for the initial registration or renewal registration of30
5252 a motor vehicle that is an alternative fueled vehicle and payment of a fee of $3.00, the31
5353 department shall provide the owner with two alternative fueled vehicle stickers. 32
5454 Alternative fueled vehicle stickers shall be of a design and material approved by the33
5555 department, provided that a separate design shall be used for each type of alternative fuel34
5656 and such stickers shall be of a size suitable for placement in the bottom corner of a35
5757 windshield with minimal obstruction of view for an operator. The department shall take36
5858 into consideration design standards set by the Society of Automotive Engineers in37
5959 designing alternative fueled vehicle stickers.38
6060 (c) Any person who owns an alternative fueled vehicle registered in this state shall affix39
6161 alternative fueled vehicle stickers to the bottom corner of the driver's side of the front and40
6262 rear windshield.41

6565 (d)(1) Except as otherwise provided for in paragraph (2) of this subsection, a person who42
6666 fails to identify an alternative fueled vehicle as required in subsection (c) of this Code43
6767 section shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished44
6868 by a fine not exceeding $100.00.45
6969 (2) The requirement set forth in subsection (c) of this Code section shall not apply:46
7070 (A) Within the first 45 days of any initial purchase of an alternative fueled vehicle; or47
7171 (B) Until an owner's registration period expires for an alternative fueled vehicle that48
7272 was registered in this state prior to January 1, 2026."49

7474 Said title is further amended in Code Section 40-2-26, relating to form and contents of51
7575 application for registration, heavy vehicle tax, and satisfactory proof of insurance coverage,52
7676 by revising paragraph (1) of subsection (b) as follows:53
7777 "(b)(1) Application shall be made by the owner of the vehicle upon a form prepared by54
7878 the commissioner for such purposes setting forth the name, place of residence, and55
7979 address of the applicant; a brief description of the vehicle to be registered, including its56
8080 name and model, the name of the manufacturer, the manufacturer's vehicle identification57
8181 number, and its shipping weight and carrying capacity, and whether it is an alternative58
8282 fueled vehicle as such term is defined in Code Section 40-1-10; from whom, where, and59
8383 when the vehicle was purchased; the total amount of all liens, if any, thereon, with the60
8484 name and address of the lienholder; and such other information as the commissioner may61
8585 require. Such application shall include a method for indicating whether the application62
8686 is for a digital license plate issued pursuant to Article 2B of this chapter."63

8888 This Act shall become effective on January 1, 2026.65
