17-To amend Article 1 of Chapter 24 of Title 33 of the Official Code of Georgia Annotated,

196 relating to general provisions regarding insurance, so as to require major medical coverage2
207 for annual prostate cancer screenings for certain men; to provide for definitions; to provide3
218 for related matters; to provide for an effective date and applicability; to repeal conflicting4
229 laws; and for other purposes.5
2310 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
2411 SECTION 1.7
2512 Article 1 of Chapter 24 of Title 33 of the Official Code of Georgia Annotated, relating to8
2613 general provisions regarding insurance, is amended by adding a new Code section to read as9
2714 follows:10

3016 (a) As used in this Code section, the term:12
3117 (1) 'Health benefit policy' means any individual or group plan, policy, or contract for13
3218 healthcare services issued, delivered, issued for delivery, or renewed in this state which14
3319 provides major medical benefits by a healthcare corporation, health maintenance15
3420 organization, preferred provider organization, accident and sickness insurer, fraternal16

3723 benefit society, hospital service corporation, medical service corporation, or other insurer17
3824 or similar entity.18
3925 (2) 'Men with a family history of prostate cancer' means men who have a first-degree19
4026 relative:20
4127 (A) Who has been diagnosed with prostate cancer;21
4228 (B) Who developed prostate cancer;22
4329 (C) Whose death was a result of prostate cancer;23
4430 (D) Who has been diagnosed with a cancer known to be associated with an increased24
4531 risk of prostate cancer; or25
4632 (E) Who has a genetic alteration known to be associated with an increased risk of26
4733 prostate cancer.27
4834 (3) 'Men with a high risk for prostate cancer' means:28
4935 (A) Men with a family history of prostate cancer who are 40 to 49 years of age;29
5036 (B) Men who are 50 years of age and older; and30
5137 (C) Other men, as may be determined by a physician.31
5238 (b) A health benefit policy shall provide coverage for annual prostate cancer screenings32
5339 for men with a high risk for prostate cancer. Such coverage shall include a digital rectal33
5440 examination and a prostate-specific antigen test."34
5541 SECTION 2.35
5642 This Act shall become effective upon its approval by the Governor or upon its becoming law36
5743 without such approval and shall apply to all applicable insurance policies issued, delivered,37
5844 issued for delivery, or renewed on or after January 1, 2026.38
5945 SECTION 3.39
6046 All laws and parts of laws in conflict with this Act are repealed.40
