	2	+	The House Committee on Insurance offers the following substitute to HB 373:
15	3		A BILL TO BE ENTITLED
16	4		AN ACT
17		-	To amend Article 1 of Chapter 24 of Title 33 of the Official Code of Georgia Annotated,

	5	+	To amend Article 1 of Chapter 24 of Title 33 of the Official Code of Georgia Annotated,1
19	6		relating to general provisions regarding insurance, so as to require major medical coverage2
20	7		for annual prostate cancer screenings for certain men; to provide for definitions; to provide3
21	8		for related matters; to provide for an effective date and applicability; to repeal conflicting4
22	9		laws; and for other purposes.5
23	10		BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
24	11		SECTION 1.7
25	12		Article 1 of Chapter 24 of Title 33 of the Official Code of Georgia Annotated, relating to8
26	13		general provisions regarding insurance, is amended by adding a new Code section to read as9
27	14		follows:10

30	16		(a) As used in this Code section, the term:12
31	17		(1) 'Health benefit policy' means any individual or group plan, policy, or contract for13
32	18		healthcare services issued, delivered, issued for delivery, or renewed in this state which14
33	19		provides major medical benefits by a healthcare corporation, health maintenance15
34	20		organization, preferred provider organization, accident and sickness insurer, fraternal16

37	23		benefit society, hospital service corporation, medical service corporation, or other insurer17
38	24		or similar entity.18
39	25		(2) 'Men with a family history of prostate cancer' means men who have a first-degree19
40	26		relative:20
41	27		(A) Who has been diagnosed with prostate cancer;21
42	28		(B) Who developed prostate cancer;22
43	29		(C) Whose death was a result of prostate cancer;23
44	30		(D) Who has been diagnosed with a cancer known to be associated with an increased24
45	31		risk of prostate cancer; or25
46	32		(E) Who has a genetic alteration known to be associated with an increased risk of26
47	33		prostate cancer.27
48	34		(3) 'Men with a high risk for prostate cancer' means:28
49	35		(A) Men with a family history of prostate cancer who are 40 to 49 years of age;29
50	36		(B) Men who are 50 years of age and older; and30
51	37		(C) Other men, as may be determined by a physician.31
52	38		(b) A health benefit policy shall provide coverage for annual prostate cancer screenings32
53	39		for men with a high risk for prostate cancer. Such coverage shall include a digital rectal33
54	40		examination and a prostate-specific antigen test."34
55	41		SECTION 2.35
56	42		This Act shall become effective upon its approval by the Governor or upon its becoming law36
57	43		without such approval and shall apply to all applicable insurance policies issued, delivered,37
58	44		issued for delivery, or renewed on or after January 1, 2026.38
59	45		SECTION 3.39
60	46		All laws and parts of laws in conflict with this Act are repealed.40
