The House Committee on Health offers the following substitute to HB 382:
A BILL TO BE ENTITLED
AN ACT
To amend Code Section 16-13-25 of the Official Code of Georgia Annotated, relating to1
Schedule I controlled substances, so as to revise a provision relating to psilocybin; to provide2
for related matters; to repeal conflicting laws; and for other purposes.3
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:4
SECTION 1.5
Code Section 16-13-25 of the Official Code of Georgia Annotated, relating to Schedule I6
controlled substances, is amended by revising subparagraph (N) of paragraph (3) as follows:7
"(N) Psilocybin. Such term does not include drugs containing crystalline polymorph8
psilocybin that are approved by the federal Food and Drug Administration under9
Section 505 of the federal Food, Drug, and Cosmetic Act, which drug shall be10
scheduled in accordance with its scheduling by the United States Drug Enforcement11
Administration and listing in the federal Controlled Substances Act, 21 U.S.C.12
Section 812. Nothing in this subparagraph shall abrogate or otherwise affect any power13
of the Board of Pharmacy, including any emergency power, under any other applicable14
provisions of law;"15

SECTION 2.16
All laws and parts of laws in conflict with this Act are repealed.17
