1010 Annotated, relating to Brady Law Regulations, so as to require a three-day waiting period for2
1111 the purchase or transfer of certain firearms; to provide for inspection; to provide for3
1212 exceptions; to provide for criminal penalties; to provide for related matters; to repeal4
1313 conflicting laws; and for other purposes.5
1414 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
1515 SECTION 1.7
1616 Part 5 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia Annotated,8
1717 relating to Brady Law Regulations, is amended by adding a new Code section to read as9
1818 follows:10
1919 "16-11-172.1.

2121 (a) No purchase or transfer of a firearm conducted by a licensed importer, licensed12
2222 manufacturer, or licensed dealer shall be completed until the third day after the initiation13
2323 of such purchase or transfer; provided, however, that the calculation of the three days shall14
2424 not include Saturdays, Sundays, or state or federal holidays and provided, further, that the15

2727 NICS check provided for under Code Section 16-11-172 may be conducted within the three16
2828 days.17
2929 (b) Licensed importers, licensed manufacturers, and licensed dealers shall, during normal18
3030 business hours, make records available for inspection by any law enforcement agency for19
3131 purposes of any criminal investigation.20
3232 (c) Subsection (a) of this Code section shall not apply when a firearm is being purchased21
3333 by or transferred to:22
3434 (1) The holder of a weapons carry license issued pursuant to Code Section 16-11-129;23
3535 or24
3636 (2) Any person provided for under Code Section 16-11-130.25
3737 (d) Any licensed importer, licensed manufacturer, or licensed dealer that violates this Code26
3838 section, or any purchaser or transferee who uses fraud or false representation to avoid the27
3939 requirements of subsection (a) of this Code section, shall be guilty of a felony and, upon28
4040 conviction, shall be punished by imprisonment for not less than one nor more than five29
4141 years."30
4242 SECTION 2.31
4343 All laws and parts of laws in conflict with this Act are repealed.32
