10	7		(Ga. L. 1916, p. 349), as amended, particularly by an Act approved February 17, 20222
11	8		(Ga. L. 2022, p. 4500), so as to change the description of the commissioner districts; to3
12	9		provide for definitions and inclusions; to provide for the continuation in office of current4
13	10		members; to provide for effective dates; to provide for related matters; to repeal conflicting5
14	11		laws; and for other purposes.6
15	12		BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7
16	13		SECTION 1.8
17	14		Act creating a board of commissioners for Banks County, approved August 19, 19169
18	15		(Ga. L. 1916, p. 349), as amended, particularly by an Act approved February 17, 202210
19	16		(Ga. L. 2022, p. 4500), is amended by revising Section 2 as follows:11
20	17		"SECTION 2.12
21	18		(a) For the purpose of electing members of the board of commissioners, Banks County13
22	19		shall be divided into five commissioner districts. Commissioner Districts 1, 2, 3, and 414

25		-	shall be and correspond to those four numbered districts described in Appendix A, attached

	22	+	shall be and correspond to those four numbered districts described in Appendix A, attached15
27	23		to and made a part of this Act and further identified as 'User: Banks CC Plan Name:16
28	24		BanksCC-2025 Plan Type: Local'. Commissioner District 5 shall be comprised of the17
29	25		entire geographic area of Banks County and the person elected from such district shall18
30	26		serve as the chairperson of the board of commissioners.19
31	27		(b)(1) For the purposes of such plan:20
32	28		(A) The term 'VTD' shall mean and describe the same geographical boundaries as21
33	29		provided in the report of the Bureau of the Census for the United States decennial22
34	30		census of 2020 for the State of Georgia. The separate numeric designations in a district23
35	31		description which are underneath a VTD heading shall mean and describe individual24
36	32		Blocks within a VTD as provided in the report of the Bureau of the Census for the25
37	33		United States decennial census of 2020 for the State of Georgia; and26
38	34		(B) Except as otherwise provided in the description of any district, whenever the27
39	35		description of any district refers to a named city, it shall mean the geographical28
40	36		boundaries of that city as shown on the census maps for the United States decennial29
41	37		census of 2020 for the State of Georgia.30
42	38		(2) Any part of Banks County which is not included in any district described in31
43	39		subsection (a) of this section shall be included within that district contiguous to such part32
44	40		which contains the least population according to the United States decennial census33
45	41		of 2020 for the State of Georgia.34
46	42		(3) Any part of Banks County which is described in subsection (a) of this section as35
47	43		being included in a particular district shall nevertheless not be included within such36
48	44		district if such part is not contiguous to such district. Such noncontiguous part shall37
49	45		instead be included within that district contiguous to such part which contains the least38
50	46		population according to the United States decennial census of 2020 for the State of39
51	47		Georgia."40

56	51		(a) Those members of the Board of Commissioners of Banks County who are serving as42
57	52		such on the effective date of this Act and any person selected to fill a vacancy in any such43
58	53		office shall continue to serve as such members until the regular expiration of their respective44
59	54		terms of office and upon the election and qualification of their respective successors.45
60	55		(b) Commissioner Districts 1, 2, 3, and 4, as they exist immediately prior to the effective46
61	56		date of this Act, shall continue to be designated as Commissioner Districts 1, 2, 3, and 4,47
62	57		respectively, but as newly described under this Act, and on and after the effective date of this48
63	58		Act, such members of the board serving from those former commissioner districts shall be49
64	59		deemed to be serving from and representing their respective districts as newly described50
65	60		under this Act.51
66	61		SECTION 3.52
67	62		This Act shall become effective upon its approval by the Governor or upon its becoming law53
68	63		without such approval.54
69	64		SECTION 4.55
70	65		All laws and parts of laws in conflict with this Act are repealed.56
