2+The Senate Committee on Natural Resources and the Environment offered the
3+following substitute to HB 443:
44 A BILL TO BE ENTITLED
55 AN ACT
6-To amend Chapter 2 of Title 26 of the Official Code of Georgia Annotated, relating to1
7-standards, labeling, and adulteration of food, so as to repeal Article 18, relating to raw dairy;2
8-to repeal related provisions; to amend Code Section 27-2-23 of the Official Code of Georgia3
9-Annotated, relating to license, permit, tag, and stamp fees, so as to provide for fees for reef4
10-and migratory fish endorsements; to provide for recreational and commercial fishing; to5
11-provide for retention of certain fees; to provide for related matters; to repeal conflicting laws;6
12-and for other purposes.7
13-BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:8
14-SECTION 1.9
15-Chapter 2 of Title 26 of the Official Code of Georgia Annotated, relating to standards,10
16-labeling, and adulteration of food, is amended by repealing Article 18, relating to raw dairy,11
17-and any references to such article and to "raw milk" as regulated by such article in the12
18-Official Code of Georgia Annotated.13

21-Code Section 27-2-23 of the Official Code of Georgia Annotated, relating to license, permit,15
22-tag, and stamp fees, is amended by adding new subparagraphs to paragraph (4), revising16
23-paragraph (11), and adding a new paragraph to read as follows:17
24-"(K) Resident reef/migratory fish18
25-endorsement19

7+license, permit, tag, and stamp fees, so as to provide for fees for reef and migratory fish2
8+endorsements; to provide for recreational and commercial fishing; to provide for retention3
9+of certain fees; to provide for related matters; to repeal conflicting laws; and for other4
10+purposes.5
11+BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
12+SECTION 1.7
13+Code Section 27-2-23 of the Official Code of Georgia Annotated, relating to license, permit,8
14+tag, and stamp fees, is amended by adding new subparagraphs to paragraph (4), revising9
15+paragraph (11), and adding a new paragraph to read as follows:10

30-"(11) For wildlife that may be legally taken by recreational or commercial fishing gear22
31-as authorized in this title or by board rule, the board may designate which species of23
32-wildlife or species grouping of wildlife require a recreational or commercial fishing24
33-species endorsement for a fee shown in subparagraphs (K) and (L) of paragraph (4) or25
34-subparagraphs (C) and (D) of paragraph (6) of this Code section in addition to the26
35-required recreational or commercial fishing license. Each species or group of species so27
36-designated shall require a separate recreational or commercial fishing species28
37-endorsement."29
38-"(12.1) Any fees collected pursuant to subparagraphs (K) and (L) of paragraph (4) of this30
39-Code section shall be retained by the department pursuant to Code Section 45-12-92.1."31
40-SECTION 3.32
41-All laws and parts of laws in conflict with this Act are repealed.33
