1616 AN ACT
1717 To amend Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated,

1919 relating to medical assistance generally, so as to authorize the Department of Community2
2020 Health to submit a Section 1115 waiver request to the United States Department of Health3
2121 and Human Services Centers for Medicare and Medicaid Services; to authorize additional4
2222 qualifying activity types; to provide for definitions; to provide for related matters; to provide5
2323 for an effective date; to repeal conflicting laws; and for other purposes.6
2424 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7
2525 SECTION 1.8
2626 Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, relating to9
2727 medical assistance generally, is amended by adding a new Code section to read as follows:10

3030 The department shall be authorized to submit a waiver request, on or before September 30,12
3131 2025, to the United States Department of Health and Human Services Centers for Medicare13
3232 and Medicaid Services pursuant to Section 1115 of the federal Social Security Act, which14
3333 includes childcare and caregiving as qualifying activities. For purposes of this Code15
3434 section, the term 'childcare' means full-time or part-time work by a parent caring for a child16

3737 or children, in their own residence; and the term 'caregiving' means full-time or part-time17
3838 work by a family member caring for an adult child with a disability or an aging parent. 18
3939 Further, upon approval of the waiver, the department shall be authorized to take all19
4040 necessary steps to implement the terms and conditions of the waiver."20
4141 SECTION 2.21
4242 This Act shall become effective upon its approval by the Governor or upon its becoming law22
4343 without such approval.23
4444 SECTION 3.24
4545 All laws and parts of laws in conflict with this Act are repealed.25
