1717 To amend Code Section 47-23-64 of the Official Code of Georgia Annotated, relating to

1919 transfer of funds from the Employees' Retirement System of Georgia to the Georgia Judicial2
2020 Retirement System by superior court judges, district attorneys, or solicitors-general and3
2121 crediting service, so as to provide that any member of such retirement system shall be4
2222 eligible to transfer funds; to provide conditions for an effective date and automatic repeal;5
2323 to repeal conflicting laws; and for other purposes.6
2424 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7
2525 SECTION 1.8
2626 Code Section 47-23-64 of the Official Code of Georgia Annotated, relating to transfer of9
2727 funds from the Employees' Retirement System of Georgia to the Georgia Judicial Retirement10
2828 System by superior court judges, district attorneys, or solicitors-general and crediting service,11
2929 is amended by revising paragraph (1) of subsection (a) as follows:12
3030 "(a)(1) Any superior court judge, state court judge, solicitor general, or district attorney

3232 member of this retirement system who was previously an active member of the14
3333 Employees' Retirement System of Georgia may elect to have all contributions made by15
3434 or on behalf of such member transferred from such retirement system to this retirement16

3737 system. Any such member shall notify the board of trustees of each retirement system

3939 not later than December 31, 2002
4040 2026, or within 90 days after first becoming a member18
4141 of this retirement system, whichever date is later."19
4242 SECTION 2.20
4343 This Act shall become effective on July 1, 2026, only if it is determined to have been21
4444 concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia22
4545 Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not23
4646 become effective and shall be automatically repealed in its entirety on July 1, 2026, as24
4747 required by subsection (a) of Code Section 47-20-50.25
4848 SECTION 3.26
4949 All laws and parts of laws in conflict with this Act are repealed.27
