55 Vehicle Dealers and Used Motor Vehicle Parts Dealers; and for other purposes.2
66 WHEREAS, according to the Georgia Department of Revenue, there has been a dramatic3
77 increase in the number of illegal temporary operating permits issued by Georgia licensed4
88 dealers in this state and in other states; and5
99 WHEREAS, the department reports that a substantial number of licensed dealers are selling6
1010 temporary operating permits, which is illegal, and improperly issuing multiple temporary7
1111 operating permits to customers when the dealers cannot timely process the title application;8
1212 and9
1313 WHEREAS, lawmakers and industry leaders have expressed concerns over the abuse of10
1414 dealer plates with how the plates are used to avoid the payment of title ad valorem taxes on11
1515 luxury motor vehicles and to avoid personal responsibility for citations for moving violations12
1616 and unpaid tolls; and13

1819 WHEREAS, the department reports that it has discovered licensed motor vehicle dealers14
1920 selling or renting their dealer plates, which is illegal, and even sharing forged copies of their15
2021 dealer plates; and16
2122 WHEREAS, law enforcement officials report that criminals in Georgia and other states have17
2223 used illegally issued temporary operating permits, rented dealer plates, and forged copies of18
2324 dealer plates to move stolen motor vehicles and drugs, avoid payment of title ad valorem tax19
2425 and title and registration fees, operate vehicles without passing required federal emissions20
2526 standards, and operate vehicles without minimum liability insurance; and21
2627 WHEREAS, although temporary operating permits and motor vehicle dealer license plates22
2728 are overseen by the Department of Revenue, used car dealers are currently regulated by the23
2829 State Board of Registration of Used Motor Vehicle Dealers and Used Motor Vehicle Parts24
2930 Dealers which is overseen by the Secretary of State's office; and25
3031 WHEREAS, study is needed to determine whether regulation of the used motor vehicle26
3132 industry would be best suited within the same agency that is responsible for issuing license27
3233 plates that are essential for the operation of such business.28
3334 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES:29
3435 (1) Creation of House study committee. There is created the House Study Committee30
3536 on the State Board of Registration of Used Motor Vehicle Dealers and Used Motor31
3637 Vehicle Parts Dealers.32
3738 (2) Members and officers. The committee shall be composed of the following33
3839 members:34
3940 (A) The Speaker of the House of Representatives shall appoint four members of the35
4041 House of Representatives as members of the committee, one of whom shall be the36

4244 chairperson of the House Committee on Motor Vehicles and one of whom shall be the37
4345 chairperson of the House Committee on Regulated Industries. The Speaker of the38
4446 House of Representatives shall also designate one of such members as chairperson;39
4547 (B) The Secretary of State or his or her designee;40
4648 (C) The commissioner of the Department of Revenue or his or her designee;41
4749 (D) One representative from a state or local law enforcement agency with experience42
4850 in motor vehicle crimes, who shall be appointed by the Speaker of the House of43
4951 Representatives; and44
5052 (E) One member of the Georgia Motor Vehicle Crime Prevention Advisory Board,45
5153 who shall be appointed by the Speaker of the House of Representatives.46
5254 (3) Powers and duties. The committee shall undertake a study of the conditions, needs,47
5355 issues, and problems mentioned above or related thereto and recommend any action or48
5456 legislation which the committee deems necessary or appropriate.49
5557 (4) Meetings. The chairperson shall call all meetings of the committee. The committee50
5658 may conduct such meetings at such places and at such times as it may deem necessary or51
5759 convenient to enable it to exercise fully and effectively its powers, perform its duties, and52
5860 accomplish the objectives and purposes of this resolution.53
5961 (5) Allowances, expenses, and funding.54
6062 (A) The legislative members of the committee shall receive the allowances provided55
6163 for in Code Section 28-1-8 of the Official Code of Georgia Annotated.56
6264 (B) Members of the committee who are state officials, other than legislative members,57
6365 or state employees shall receive no compensation for their services on the committee,58
6466 but they may be reimbursed for expenses incurred by them in the performance of their59
6567 duties as members of the committee in the same manner as they are reimbursed for60
6668 expenses in their capacities as state officials or employees.61
6769 (C) Members of the committee who are not legislators, state officials, or state62
6870 employees shall receive a daily expense allowance in an amount the same as that63

7073 specified in subsection (b) of Code Section 45-7-21 of the Official Code of Georgia64
7174 Annotated, as well as the mileage or transportation allowance authorized for state65
7275 employees.66
7376 (D) The allowances and expenses authorized by this resolution shall not be received67
74-by any member of the committee for more than three days unless additional days are68
77+by any member of the committee for more than five days unless additional days are68
7578 authorized. Funds necessary to carry out the provisions of this resolution shall come69
7679 from funds appropriated to the House of Representatives; except that funds for the70
7780 reimbursement of the expenses of state officials, other than legislative members, and71
7881 state employees shall come from funds appropriated to or otherwise available to their72
7982 respective agencies.73
8083 (6) Report.74
8184 (A) In the event the committee adopts any specific findings or recommendations that75
8285 include suggestions for proposed legislation, the chairperson shall file a report of the76
8386 same prior to the date of abolishment specified in this resolution, subject to77
8487 subparagraph (C) of this paragraph.78
8588 (B) In the event the committee adopts a report that does not include suggestions for79
8689 proposed legislation, the chairperson shall file the report, subject to subparagraph (C)80
8790 of this paragraph.81
8891 (C) No report shall be filed unless the same has been approved prior to the date of82
8992 abolishment specified in this resolution by majority vote of a quorum of the committee. 83
9093 A report so approved shall be signed by the chairperson of the committee and filed with84
9194 the Clerk of the House of Representatives.85
9295 (D) In the absence of an approved report, the chairperson may file with the Clerk of the86
9396 House of Representatives a copy of the minutes of the meetings of the committee in lieu87
9497 thereof.88
9598 (7) Abolishment. The committee shall stand abolished on December 1, 2025.89
