66 A RESOLUTION
77 Proposing an amendment to the Constitution of the State of Georgia so as to provide that

99 revenue derived from the regulation of safe drinking water and toxic enforcement may be2
1010 dedicated for certain purposes and not deposited into the general fund; to authorize the3
1111 General Assembly to create the Safe Drinking Water and Toxic Enforcement Fund; to4
1212 provide that such funds shall not lapse; to provide for related matters; to provide for the5
1313 submission of this amendment for ratification or rejection; and for other purposes.6
1414 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:7
1515 SECTION 1.8
1616 Article III, Section IX of the Constitution is amended in Paragraph VI by adding a new9
1717 subparagraph to read as follows:10
1818 "(s) The General Assembly may provide by general law for the creation of the Safe

2020 Drinking Water and Toxic Enforcement Fund from which funds shall be disbursed for the12
2121 enforcement of laws regarding the protection of the citizens of this state from carcinogens13
2222 and toxic substances in drinking water and the protection of the citizens of this state from14
2323 exposure to carcinogens and toxic substances by businesses in the course of doing business. 15
2424 The General Assembly shall be authorized to dedicate and deposit revenues raised from16
2525 specified sources to the fund and shall be authorized to appropriate other funds to the fund. 17

2828 Such fund and its proceeds shall not be subject to Article VII, Section III, Paragraph II;18
2929 Article III, Section IX, Paragraph VI(a); or Article III, Section IX, Paragraph IV(c) of this19
3030 Constitution. The General Assembly is authorized to provide by general law for any20
3131 matters relating to the purpose or provisions of this subparagraph."21
3232 SECTION 2.22
3333 The above proposed amendment to the Constitution shall be published and submitted as23
3434 provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the24
3535 above proposed amendment shall have written or printed thereon the following:25

3939 Shall the Constitution of Georgia be amended so as provide that the revenue
4040 derived from the regulation of safe drinking water and toxic enforcement may
4141 be dedicated for certain purposes and not deposited into the general fund?"
4242 All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes."

4444 All persons desiring to vote against ratifying the proposed amendment shall vote "No." If30
4545 such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall31
4646 become a part of the Constitution of this state.32
