| 13 | 13 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 |

| 14 | 14 | | SECTION 1.7 |
|---|
| 15 | 15 | | Article 5 of Chapter 2 of Title 47 of the Official Code of Georgia Annotated, relating to8 |
|---|
| 16 | 16 | | service creditable toward retirement benefits, is amended by revising Code Section 47-2-95,9 |
|---|
| 17 | 17 | | which is designated as reserved, as follows:10 |
|---|
| 18 | 18 | | "47-2-95.11 |
|---|
| 19 | 19 | | (a) A member with at least ten years of membership service may obtain up to 36 months |
|---|
| 20 | 20 | | 12 |
|---|
| 21 | 21 | | of creditable service to be awarded month for month for active military service in the13 |
|---|
| 22 | 22 | | armed forces of the United States performed on or after January 1, 1990.14 |
|---|
| 23 | 23 | | (b) To obtain such creditable service, a member shall:15 |
|---|
| 24 | 24 | | (1) Apply in a method or manner to be prescribed by the board of trustees;16 |
|---|

| 27 | 27 | | (2) Submit proof of qualifying active military service as the board of trustees shall deem17 |
|---|
| 28 | 28 | | necessary; and18 |
|---|
| 29 | 29 | | (3) Pay to the board of trustees an amount determined by such board to be equal to the19 |
|---|
| 30 | 30 | | full actuarial cost of such creditable service.20 |
|---|
| 31 | 31 | | (c) Following its approval of an application for creditable service pursuant to this Code21 |
|---|
| 32 | 32 | | section, the board of trustees shall certify to the applicant the amount of the payment to the22 |
|---|
| 33 | 33 | | retirement system required to earn creditable service pursuant to this Code section.23 |
|---|
| 34 | 34 | | (d) A member may make a one-time payment of the full amount established by the board24 |
|---|
| 35 | 35 | | of trustees pursuant to subsection (c) of this Code section within 90 days and thereafter25 |
|---|
| 36 | 36 | | receive such creditable service to which he or she is entitled or may elect to participate in26 |
|---|
| 37 | 37 | | a payment plan under the same terms provided for in subsection (e) of Code27 |
|---|
| 38 | 38 | | Section 47-2-101.28 |
|---|
| 39 | 39 | | (e) Pursuant to this Code section, no member shall receive creditable service:29 |
|---|
| 40 | 40 | | (1) If such member was not honorably discharged;30 |
|---|
| 41 | 41 | | (2) For reserve duty;31 |
|---|
| 42 | 42 | | (3) For any period of time for which he or she obtained membership service; or32 |
|---|
| 43 | 43 | | (4) For any portion of such member's active military service in the armed forces of the33 |
|---|
| 44 | 44 | | United States that has been or will be used in the determination of eligibility for34 |
|---|
| 45 | 45 | | retirement benefits or allowances from any other state or federal retirement program,35 |
|---|
| 46 | 46 | | excluding social security. Reserved."36 |

| 47 | 47 | | SECTION 2.37 |
|---|
| 48 | 48 | | This Act shall become effective on July 1, 2026, only if it is determined to have been38 |
|---|
| 49 | 49 | | concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia39 |
|---|
| 50 | 50 | | Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not40 |
|---|
| 51 | 51 | | become effective and shall be automatically repealed in its entirety on July 1, 2026, as41 |
|---|
| 52 | 52 | | required by subsection (a) of Code Section 47-20-50.42 |
