| 14 | 14 | | components of such systems from being conditioned upon product registration; to provide6 |
|---|
| 15 | 15 | | required information for warranty and product registration cards and forms; to provide an7 |
|---|
| 16 | 16 | | effective date for certain warranties of HVAC systems and components of such systems; to8 |
|---|
| 17 | 17 | | provide a definition; to provide for an effective date and applicability; to provide for related9 |
|---|
| 18 | 18 | | matters; to repeal conflicting laws; and for other purposes.10 |

| 19 | 19 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:11 |

|---|
| 21 | 21 | | Chapter 1 of Title 10 of the Official Code of Georgia Annotated, relating to selling and other13 |

| 22 | 22 | | trade practices, is amended by adding a new article to read as follows:14 |

| 27 | 27 | | As used in this article, the term 'HVAC' means heating, ventilation, and air-conditioning.17 |

| 29 | 29 | | (a) If a residential real property that includes an HVAC system as a fixture to the property19 |
|---|
| 30 | 30 | | is conveyed to a new owner, any manufacturer's warranty in effect on that system or any20 |
|---|
| 31 | 31 | | component of that system:21 |
|---|
| 32 | 32 | | (1) Shall be automatically transferred to the new owner; and22 |
|---|
| 33 | 33 | | (2) Shall continue in effect as if the new owner was the original purchaser of such system23 |
|---|
| 34 | 34 | | or component, as applicable.24 |
|---|
| 35 | 35 | | (b) A manufacturer shall continue to be obligated under the terms of any warranty25 |
|---|
| 36 | 36 | | transferred pursuant to subsection (a) of this Code section and shall not charge a fee for the26 |
|---|
| 37 | 37 | | transfer of such warranty.27 |
|---|
| 38 | 38 | | (c) A transfer of any manufacturer's warranty pursuant to subsection (a) of this Code28 |
|---|
| 39 | 39 | | section shall not extend the remaining term of the warranty.29 |

| 41 | 41 | | (a) The full term of a manufacturer's, distributor's, or retailer's warranty of an HVAC31 |
|---|
| 42 | 42 | | system or any component of such system shall be effective in this state on the date of32 |
|---|
| 43 | 43 | | installation if installed by a contractor licensed under Chapter 14 of Title 43.33 |
|---|
| 44 | 44 | | (b) If a manufacturer, distributor, or retailer of an HVAC system or any component of such34 |
|---|
| 45 | 45 | | system provides a warranty or product registration card or form, or an electronic, online35 |
|---|
| 46 | 46 | | warranty or product registration form, the card or form shall contain the following36 |
|---|
| 47 | 47 | | information, displayed in a clear and conspicuous manner:37 |
|---|
| 48 | 48 | | (1) The card or form is for registration of the product; and38 |
|---|

| 51 | 51 | | (2) Failure to complete and return the card or form shall not diminish any warranty rights39 |
|---|
| 52 | 52 | | or decrease the warranty term.40 |
|---|
| 53 | 53 | | (c) Any warranty of an HVAC system or any component of such system manufactured and41 |
|---|
| 54 | 54 | | issued, sold, or offered for sale by a manufacturer, distributor, or retailer shall not be in any42 |
|---|
| 55 | 55 | | way conditioned upon product registration."43 |
|---|
| 56 | 56 | | SECTION 2.44 |
|---|
| 57 | 57 | | (a) This Act shall become effective on January 1, 2026.45 |
|---|
| 58 | 58 | | (b) This Act shall apply to any warranty of an HVAC system or any component of such46 |
|---|
| 59 | 59 | | system manufactured and issued, sold, or offered for sale by a manufacturer, distributor, or47 |
|---|
| 60 | 60 | | retailer on or after the effective date of this Act and to any modifications or extensions of48 |
|---|
| 61 | 61 | | such warranties issued, sold, or offered for sale on or after such date.49 |
|---|
| 62 | 62 | | SECTION 3.50 |
|---|
| 63 | 63 | | All laws and parts of laws in conflict with this Act are repealed.51 |
