1313 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
1414 SECTION 1.7
1515 Part 5 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia Annotated,8
1616 relating to Brady Law Regulations, is amended by revising Code Section 16-11-171, relating9
1717 to definitions, as follows:10
1818 "16-11-171.11
1919 As used in this part, the term:12
2020 (1) 'Center' means the Georgia Crime Information Center within the Georgia Bureau of13
2121 Investigation.14
2222 (2) 'Dealer' means any person licensed as a dealer pursuant to 18 U.S.C. Section 921, et15
2323 seq.16

2626 (3) 'Firearm' means any weapon that is designed to or may readily be converted to expel

2828 a projectile by the action of an explosive or the frame or receiver of any such weapon,18
2929 any firearm muffler or firearm silencer, or any destructive device as defined in 18 U.S.C.19
3030 Section 921(a)(3).20
3131 (4) 'Involuntarily hospitalized' means hospitalized as an inpatient in any mental health21
3232 facility pursuant to Code Section 37-3-81 or hospitalized as an inpatient in any mental22
3333 health facility as a result of being adjudicated mentally incompetent to stand trial or being23
3434 adjudicated not guilty by reason of insanity at the time of the crime pursuant to Part 2 of24
3535 Article 6 of Chapter 7
3636 of Title 17.25
3737 (5) 'NICS' means the National Instant Criminal Background Check System created by26
3838 the federal 'Brady Handgun Violence Prevention Act' (P. L. No. 103-159).27
3939 (6) 'Pistol grip' means a grip or similar feature on a weapon that can function as a grip28
4040 for the trigger hand.29
4141 (7) 'Semiautomatic assault weapon' means:30
4242 (A) Any selective firearm capable of fully semiautomatic or burst fire at the option of31
4343 the user;32
4444 (B) Any revolving cylinder shotgun;33
4545 (C) Any semiautomatic rifle that can accommodate a detachable magazine and that has34
4646 at least two of the following:35
4747 (i) A folding or telescoping stock;36
4848 (ii) A pistol grip that protrudes conspicuously beneath the action of the weapon;37
4949 (iii) A bayonet mount;38
5050 (iv) A flash suppressor or threaded barrel designed to accommodate a flash39
5151 suppressor; or40
5252 (v) A grenade launcher;41
5353 (D) A semiautomatic pistol that can accommodate a detachable magazine and that has42
5454 at least two of the following:43

5757 (i) An ammunition magazine that attaches to the pistol outside of the pistol grip;44
5858 (ii) A threaded barrel that can accommodate a barrel extender, flash suppressor,45
5959 forward handgrip, or silencer;46
6060 (iii) A shroud that is attached to, or partially or completely encircles, the barrel and47
6161 that allows the shooter to hold the firearm with the nontrigger hand without being48
6262 burned;49
6363 (iv) A manufactured weight of 50 ounces or more when the pistol is unloaded; or50
6464 (v) A semiautomatic version of an automatic firearm; or51
6565 (E) A semiautomatic shotgun that has at least two of the following:52
6666 (i) A folding or telescoping stock;53
6767 (ii) A pistol grip that protrudes conspicuously beneath the action of the weapon;54
6868 (iii) A fixed magazine capacity in excess of five rounds; or55
6969 (iv) The capability to accommodate a detachable magazine."56

7171 Said part is further amended by adding a new Code section to read as follows:58
7272 "16-11-172.1.59
7373 (a) No transfer or purchase of a semiautomatic assault weapon conducted by a licensed60
7474 importer, licensed manufacturer, or licensed dealer shall be completed until the tenth day61
7575 after the initiation of such transfer or purchase; provided, however, that the calculation of62
7676 the ten days shall not include Saturdays, Sundays, or state or federal holidays; and63
7777 provided, further, that an NICS check may be conducted within such ten days.64
7878 (b) Licensed importers, licensed manufacturers, and licensed dealers shall, during normal65
7979 business hours, make records available for inspection by any law enforcement agency for66
8080 purposes of any criminal investigation.67
8181 (c) Subsection (a) of this Code section shall not apply when a semiautomatic assault68
8282 weapon is being transferred to or purchased by:69

8585 (1) The holder of a weapons carry license issued pursuant to Code Section 16-11-129;70
8686 or71
8787 (2) Any person provided for under Code Section 16-11-130.72
8888 (d) Any licensed importer, licensed manufacturer, or licensed dealer that violates this Code73
8989 section or any purchaser or transferee that uses fraud or false representation to avoid the74
9090 requirements of subsection (a) of this Code section shall be guilty of a felony and, upon75
9191 conviction, shall be punished by imprisonment for not less than one nor more than five76
9292 years."77
9393 SECTION 3.78
9494 All laws and parts of laws in conflict with this Act are repealed.79
