77 To amend Chapter 23 of Title 2 of the Official Code of Georgia Annotated, the "Georgia

99 Hemp Farming Act," and Chapter 3 of Title 3 of the Official Code of Georgia Annotated,2
1010 relating to regulation of alcoholic beverages generally, so as to prohibit the issuance of3
1111 wholesale consumable hemp licenses to wholesale dealers of alcoholic beverages; to prohibit4
1212 wholesale dealers of alcoholic beverages from selling or otherwise distributing consumable5
1313 hemp products; to provide for related matters; to repeal conflicting laws; and for other6
1414 purposes.7
1515 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:8
1616 SECTION 1.9
1717 Chapter 23 of Title 2 of the Official Code of Georgia Annotated, the "Georgia Hemp10
1818 Farming Act," is amended by revising Code Section 2-23-6.3, relating to wholesale11
1919 consumable hemp establishment licenses, as follows:12
2020 "2-23-6.3.13
2121 (a) Except as otherwise provided in this chapter, consideration, issuance, and revocation14
2222 of wholesale consumable hemp licenses issued by the department pursuant to this Code15

2525 section shall be accomplished in accordance with Chapter 5 of this title, and such licenses

2727 shall otherwise be governed by such chapter.17
2828 (b) Applications for a wholesale consumable hemp license shall be made on a form18
2929 furnished by the Commissioner and, together with such other information as the19
3030 Commissioner may require, shall state:20
3131 (1) The name of the applicant;21
3232 (2) The business address of the applicant;22
3333 (3) The complete telephone number and email address of the applicant;23
3434 (4) The location of the facility where the applicant will store consumable hemp products24
3535 and otherwise operate as a wholesaler of consumable hemp products in this state and25
3636 whether such facility is owned or leased by the applicant; and26
3737 (5) If the applicant is a business entity, the name of the owners, partners, members, or27
3838 shareholders of such entity.28
3939 (c) Wholesale consumable hemp licenses shall be issued by the department for one29
4040 calendar year at an annual licensing fee of at least $500.00 but not more than $10,000.00,30
4141 as established by the Commissioner. The Commissioner may establish separate classes of31
4242 wholesale consumable hemp licenses based on the amount of consumable hemp products32
4343 to be sold by the licensee, and the annual licensing fees required by this subsection shall33
4444 be in different amounts for each such separate class of wholesale consumable hemp34
4545 licenses.35
4646 (d) Wholesale consumable hemp licenses issued by the department pursuant to this Code36
4747 section shall be issued in connection with a single facility where the licensee will store37
4848 consumable hemp products or otherwise operate as a wholesaler of consumable hemp38
4949 products. For a person to store consumable hemp products or otherwise operate as a39
5050 wholesaler of consumable hemp products at multiple facilities, such person shall be40
5151 required to obtain from the department separate wholesale consumable hemp licenses for41
5252 each such facility.42

5555 (e) No wholesale consumable hemp license shall be issued by the department pursuant to43
5656 this Code section to any person that is a licensed wholesale dealer of alcoholic beverages44
5757 under the provisions of Title 3 or to any person that is affiliated with such a licensed45
5858 wholesale dealer."46
5959 SECTION 2.47
6060 Chapter 3 of Title 3 of the Official Code of Georgia Annotated, relating to regulation of48
6161 alcoholic beverages generally, is amended by adding a new Code section to read as follows:49
6262 "3-3-35.50
6363 No licensed wholesale dealer shall sell or otherwise distribute consumable hemp products,51
6464 as such term is defined in Code Section 2-23-3."52
6565 SECTION 3.53
6666 All laws and parts of laws in conflict with this Act are repealed.54
