12 | 12 | | wholesale dealers of alcoholic beverages from selling or otherwise distributing consumable5 |

13 | 13 | | hemp products; to provide for related matters; to repeal conflicting laws; and for other6 |
---|
14 | 14 | | purposes.7 |

17 | 17 | | Chapter 23 of Title 2 of the Official Code of Georgia Annotated, the "Georgia Hemp10 |

18 | 18 | | Farming Act," is amended by revising Code Section 2-23-6.3, relating to wholesale11 |
---|
19 | 19 | | consumable hemp establishment licenses, as follows:12 |
---|
20 | 20 | | "2-23-6.3.13 |
---|
21 | 21 | | (a) Except as otherwise provided in this chapter, consideration, issuance, and revocation14 |
---|
22 | 22 | | of wholesale consumable hemp licenses issued by the department pursuant to this Code15 |

25 | 25 | | section shall be accomplished in accordance with Chapter 5 of this title, and such licenses |
---|

27 | 27 | | shall otherwise be governed by such chapter.17 |
---|
28 | 28 | | (b) Applications for a wholesale consumable hemp license shall be made on a form18 |
---|
29 | 29 | | furnished by the Commissioner and, together with such other information as the19 |
---|
30 | 30 | | Commissioner may require, shall state:20 |
---|
31 | 31 | | (1) The name of the applicant;21 |
---|
32 | 32 | | (2) The business address of the applicant;22 |
---|
33 | 33 | | (3) The complete telephone number and email address of the applicant;23 |
---|
34 | 34 | | (4) The location of the facility where the applicant will store consumable hemp products24 |
---|
35 | 35 | | and otherwise operate as a wholesaler of consumable hemp products in this state and25 |
---|
36 | 36 | | whether such facility is owned or leased by the applicant; and26 |
---|
37 | 37 | | (5) If the applicant is a business entity, the name of the owners, partners, members, or27 |
---|
38 | 38 | | shareholders of such entity.28 |
---|
39 | 39 | | (c) Wholesale consumable hemp licenses shall be issued by the department for one29 |
---|
40 | 40 | | calendar year at an annual licensing fee of at least $500.00 but not more than $10,000.00,30 |
---|
41 | 41 | | as established by the Commissioner. The Commissioner may establish separate classes of31 |
---|
42 | 42 | | wholesale consumable hemp licenses based on the amount of consumable hemp products32 |
---|
43 | 43 | | to be sold by the licensee, and the annual licensing fees required by this subsection shall33 |
---|
44 | 44 | | be in different amounts for each such separate class of wholesale consumable hemp34 |
---|
45 | 45 | | licenses.35 |
---|
46 | 46 | | (d) Wholesale consumable hemp licenses issued by the department pursuant to this Code36 |
---|
47 | 47 | | section shall be issued in connection with a single facility where the licensee will store37 |
---|
48 | 48 | | consumable hemp products or otherwise operate as a wholesaler of consumable hemp38 |
---|
49 | 49 | | products. For a person to store consumable hemp products or otherwise operate as a39 |
---|
50 | 50 | | wholesaler of consumable hemp products at multiple facilities, such person shall be40 |
---|
51 | 51 | | required to obtain from the department separate wholesale consumable hemp licenses for41 |
---|
52 | 52 | | each such facility.42 |

55 | 55 | | (e) No wholesale consumable hemp license shall be issued by the department pursuant to43 |
---|
56 | 56 | | this Code section to any person that is a licensed wholesale dealer of alcoholic beverages44 |
---|
57 | 57 | | under the provisions of Title 3 or to any person that is affiliated with such a licensed45 |
---|
58 | 58 | | wholesale dealer."46 |

61 | 61 | | alcoholic beverages generally, is amended by adding a new Code section to read as follows:49 |

63 | 63 | | No licensed wholesale dealer shall sell or otherwise distribute consumable hemp products,51 |

64 | 64 | | as such term is defined in Code Section 2-23-3."52 |
