22 | 22 | | new Code section to read as follows:15 |

26 | 26 | | (a) As used in this Code section, the term:17 |
---|
27 | 27 | | (1) 'Opioid antagonist' shall have the same meaning as set forth in Code Section18 |
---|
28 | 28 | | 20-2-776.5.19 |
---|
29 | 29 | | (2) 'Program' means the Wesley's Law Grant Program established by this Code section.20 |
---|
30 | 30 | | (3) 'Trust fund' means the state administered trust known as the Georgia Opioid Crisis21 |
---|
31 | 31 | | Abatement Trust.22 |
---|
32 | 32 | | (b) Beginning in the 2026-2027 school year, and subject to available funding, including,23 |
---|
33 | 33 | | but not limited to, appropriations by the General Assembly or trust funds obtained pursuant24 |
---|
34 | 34 | | to subsection (c) of this Code section, the State Board of Education shall establish the25 |
---|
35 | 35 | | Wesley's Law Grant Program to provide up to $3 million in grant funding for the purpose26 |
---|
36 | 36 | | of providing annual grants to participating local school systems or public schools, including27 |
---|
37 | 37 | | charter schools, to acquire and maintain a supply of opioid antagonists as necessary to28 |
---|
38 | 38 | | implement the purposes of Code Section 20-2-776.5. Such grants shall be awarded based29 |
---|
39 | 39 | | on criteria, terms, and conditions as determined by the State Board of Education.30 |
---|
40 | 40 | | (c) The Department of Education is directed to take all steps reasonably necessary to31 |
---|
41 | 41 | | obtain funding for the program from the trust fund, including, but not limited to, satisfying32 |
---|
42 | 42 | | any application requirements.33 |
---|
43 | 43 | | (d) Nothing in this Code section shall be construed to preclude a local school system or34 |
---|
44 | 44 | | public school, including a charter school, from acquiring and maintaining opioid35 |
---|
45 | 45 | | antagonists in accordance with Code Section 20-2-776.5 at its own expense.36 |
---|
46 | 46 | | (e) The Department of Education shall maintain and annually report to the Governor data37 |
---|
47 | 47 | | for the three preceding school years, including, at a minimum:38 |
---|
48 | 48 | | (1) Rates of participation by local school systems and public schools, including charter39 |
---|
49 | 49 | | schools;40 |
---|
50 | 50 | | (2) The number of opioid overdoses occurring at local school systems and public41 |
---|
51 | 51 | | schools, including charter schools;42 |
---|

54 | 54 | | (3) The number of times opioid antagonists were administered at local school systems43 |
---|
55 | 55 | | and public schools, including charter schools;44 |

56 | 56 | | (4) The outcomes of administered opioid antagonists at local school systems and public45 |

57 | 57 | | schools, including charter schools; and46 |
---|
58 | 58 | | (5) The impact of Code Section 20-2-776.5, 'Wesley's Law,' on opioid overdoses at local47 |
---|
59 | 59 | | school systems and public schools, including charter schools.48 |
---|
60 | 60 | | (f) The Department of Education is authorized to promulgate rules and regulations as49 |
---|
61 | 61 | | necessary to administer and implement this Code section."50 |
