1010 for the creation of and establish a purpose for the Wesley's Law Grant Program; to provide3
1111 for the allocation of grant awards under such program; to require the Department of4
1212 Education to pursue grant funding for such program from the Georgia Opioid Crisis5
1313 Abatement Trust; to require the State Board of Education to establish award criteria, terms,6
1414 and conditions for such program; to authorize the Department of Education to promulgate7
1515 rules and regulations necessary to implement such program; to provide for statutory8
1616 construction; to provide for annual reporting; to provide definitions; to provide for related9
1717 matters; to repeal conflicting laws; and for other purposes.10
1818 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:11
1919 SECTION 1.12
2020 Part 3 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated,13
2121 relating to student health in elementary and secondary education, is amended by adding a14
2222 new Code section to read as follows:15

2626 (a) As used in this Code section, the term:17
2727 (1) 'Opioid antagonist' shall have the same meaning as set forth in Code Section18
2828 20-2-776.5.19
2929 (2) 'Program' means the Wesley's Law Grant Program established by this Code section.20
3030 (3) 'Trust fund' means the state administered trust known as the Georgia Opioid Crisis21
3131 Abatement Trust.22
3232 (b) Beginning in the 2026-2027 school year, and subject to available funding, including,23
3333 but not limited to, appropriations by the General Assembly or trust funds obtained pursuant24
3434 to subsection (c) of this Code section, the State Board of Education shall establish the25
3535 Wesley's Law Grant Program to provide up to $3 million in grant funding for the purpose26
3636 of providing annual grants to participating local school systems or public schools, including27
3737 charter schools, to acquire and maintain a supply of opioid antagonists as necessary to28
3838 implement the purposes of Code Section 20-2-776.5. Such grants shall be awarded based29
3939 on criteria, terms, and conditions as determined by the State Board of Education.30
4040 (c) The Department of Education is directed to take all steps reasonably necessary to31
4141 obtain funding for the program from the trust fund, including, but not limited to, satisfying32
4242 any application requirements.33
4343 (d) Nothing in this Code section shall be construed to preclude a local school system or34
4444 public school, including a charter school, from acquiring and maintaining opioid35
4545 antagonists in accordance with Code Section 20-2-776.5 at its own expense.36
4646 (e) The Department of Education shall maintain and annually report to the Governor data37
4747 for the three preceding school years, including, at a minimum:38
4848 (1) Rates of participation by local school systems and public schools, including charter39
4949 schools;40
5050 (2) The number of opioid overdoses occurring at local school systems and public41
5151 schools, including charter schools;42

5454 (3) The number of times opioid antagonists were administered at local school systems43
5555 and public schools, including charter schools;44
5656 (4) The outcomes of administered opioid antagonists at local school systems and public45
5757 schools, including charter schools; and46
5858 (5) The impact of Code Section 20-2-776.5, 'Wesley's Law,' on opioid overdoses at local47
5959 school systems and public schools, including charter schools.48
6060 (f) The Department of Education is authorized to promulgate rules and regulations as49
6161 necessary to administer and implement this Code section."50
6262 SECTION 2.51
6363 All laws and parts of laws in conflict with this Act are repealed.52
