77 To amend Part 2 of Article 3 of Chapter 1 of Title 40 of the Official Code of Georgia

99 Annotated, relating to certification of motor carriers, so as to repeal the authority of the2
1010 Department of Public Safety to establish reasonable rates, fares, and charges for3
1111 transportation by motor carriers of household goods; to provide for related matters; to repeal4
1212 conflicting laws; and for other purposes.5
1313 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
1414 SECTION 1.7
1515 Part 2 of Article 3 of Chapter 1 of Title 40 of the Official Code of Georgia Annotated,8
1616 relating to certification of motor carriers, is amended by repealing in its entirety Code9
1717 Section 40-1-118, relating to establishment of rates, fares, and charges for transportation of10
1818 household goods, and designating said Code section as reserved.11
1919 SECTION 2.12
2020 Said part is further amended by revising Code Section 40-1-119, relating to charges by motor13
2121 carriers and unjust discrimination by carriers prohibited, as follows:14

2626 No motor carrier of household goods or
2727 passengers shall charge, demand, collect, or16
2828 receive a greater or lesser or different compensation for the transportation of household17
2929 goods or passengers or for any service rendered in connection therewith than the rates,18
3030 fares, and charges prescribed or approved by order of the department; nor shall any such19
3131 motor carrier unjustly discriminate against any person in its rates, fares, or charges for20
3232 service. The commissioner may prescribe, by general order, to what persons motor carriers21
3333 of passengers may issue passes or free transportation; may prescribe reduced rates for22
3434 special occasions; and may fix and prescribe rates and schedules."23
3535 SECTION 3.24
3636 All laws and parts of laws in conflict with this Act are repealed.25
