47- SECTION 1. The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows: "Chapter health information exchange. § -1 Definitions. As used in this chapter: "De-identified protected health information" has the same meaning as in title 45 Code of Federal Regulations section 164.514(a), as may be amended. "Health information" has the same meaning as in title 45 Code of Federal Regulations section 160.103, as may be amended. "Health information exchange" means a secure interoperable database operated and maintained by the state designated entity that houses the complete and accurate medical records of each patient receiving treatment at a health care or wellness service provider in the State. "Social determinants of health" include the conditions in the environments where people are born, live, learn, work, play, worship, and age that affect a wide range of health, functioning, and quality-of-life outcomes and risks. "State designated entity" means an entity designated by the governor as the entity responsible for developing and maintaining a secure interoperable data exchange to facilitate the movement and use of health information organizations according to nationally recognized standards. "Wellness service provider" means an entity or individual that provides patients with a holistic health care approach or alternative services or methods of care. § -2 Health data collection; storage. (a) A state designated entity shall develop and maintain a secure electronic gateway and health information exchange. (b) All entities delivering health and wellness services operating in the State shall submit a complete and accurate record of each patient's health care and wellness related treatments to the state designated entity for inclusion in the health information exchange. (c) Medical records transmitted to or from the health information repository shall comply with all relevant state and federal laws, including but not limited to the Health Insurance Portability and Accountability Act of 1996, P.L. 104-191, as outlined in title 45 Code of Federal Regulations part 164, and the 21st Century Cures Act of 2016, P.L. 114-255, as outlined in title 45 Code of Federal Regulations parts 170 and 171, and title 42 Code of Federal Regulations part 2. (d) Health care or wellness service providers that address social determinants of health shall make information collected relating to the social determinants of health available to the state designated entity. § -3 Use of collected health data. Entities that provide health care and wellness services may use the information provided to or from the state designated entity to establish patient portals that allow patients to access their protected health information." SECTION 2. This Act shall take effect on July 1, 2060.
