A BILL FOR AN ACT
relating to gambling.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 712-1221, Hawaii Revised Statutes, is amended to read as follows: "§712-1221 Promoting gambling in the first degree. (1) A person commits the offense of promoting gambling in the first degree if the person knowingly advances or profits from gambling activity by: (a) Engaging in bookmaking to the extent that the person receives or accepts in any seven-day period more than five bets totaling more than $500; (b) Receiving in connection with a lottery, or mutuel scheme or enterprise, money or written records from a person other than a player whose chances or plays are represented by such money or records; or (c) Receiving or having become due and payable in connection with a lottery, mutuel, or other gambling scheme or enterprise, more than $1,000 in any seven-day period played in the scheme or enterprise. (2) Promoting gambling in the first degree is a class C felony. (3) In addition to any other penalty provided by law, the prosecuting attorney shall initiate, in accordance with the requirements of chapter 712A, forfeiture proceedings against real property used in the commission of promoting gambling in the first degree when any owner of the real property has been convicted under this section of three or more separate incidents of promoting gambling in the first degree." SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date. SECTION 3. New statutory material is underscored. SECTION 4. This Act shall take effect upon its approval. INTRODUCED BY: _____________________________
