4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 SECTION 1. Section 132D-8.6, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows: "(b) The harbors division of the department of transportation shall inspect for possible violations of this chapter any shipment that has landed at a commercial harbor within the jurisdiction of the division and originating from a geographic location that is known to manufacture, use, or export aerial fireworks; provided that the harbors division shall perform these inspections using specialized canine units that have been trained in identifying explosives, gun powder, and other explosive agents commonly used in fireworks; provided further that the fire department of a county[,] in which a shipment of fireworks or articles pyrotechnic has landed and becomes subject to the jurisdiction of the fire department[,] [shall be allowed to] may inspect[, if it chooses,] any shipment declared on the shipping manifest as fireworks or articles pyrotechnic." SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2021-2022 and the same sum or so much thereof as may be necessary for fiscal year 2022-2023 for the harbors division of the department of transportation to establish specialized canine units on each island containing a commercial harbor within the division's jurisdiction; provided that each canine unit shall be trained in identifying explosives, gun powder, and other explosive agents commonly found in fireworks. The sums appropriated shall be expended by the department of transportation for the purposes of this Act. SECTION 3. Statutory material to be repealed is bracketed and stricken.
