4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 SECTION 1. Chapter 127A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows: "§127A- Medical facilities; elective surgeries. (a) Whenever the governor declares a state of emergency for the entire State or any portion thereof, or a mayor declares a local state of emergency for the county or any portion thereof, or when the State, or any portion thereof, is the subject of a health or pandemic emergency: (1) The governor shall assure the continuity of service by medical facilities, both publicly and privately owned, by regulating or, if necessary to the continuation of the service thereof, by taking over and operating the same; and (2) Any hospital, in its discretion, may suspend providing elective surgeries to address operational limits of the facility's bed capacity. (b) As used in this section, "hospital" means a facility licensed under section 321-14.5." SECTION 2. New statutory material is underscored. SECTION 3. This Act shall take effect upon its approval.
