4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. The legislature finds that the transportation of fireworks to, from, and within the State requires the use of multiple modes or methods of transport, including interstate maritime transportation and intrastate trucking. The legislature also finds that due to the diversity of transportation processes and modes and the health and safety of first responders, it is essential that accurate records are made and reported regarding imported fireworks shipments. The legislature further finds that current law requires licensed importers, wholesalers, and retailers to notify a county fire department when fireworks are shipped into the State. However, the actual shippers are not subject to these same notification requirements. The legislature believes that to ensure an additional level of safety and security for the people of the State, the State should pursue more comprehensive tracking of all shipments of fireworks imported into the State. Accordingly, the purpose of this Act is to: (1) Require shippers with knowledge that their cargo includes fireworks or articles pyrotechnic to report certain information to applicable county fire departments; and (2) Authorize county fire departments to enter shippers' vessels for the purpose of inspecting any shipment declared on the shipping manifest as fireworks or articles pyrotechnic. SECTION 2. Chapter 132D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows: "§132D- Requirements of shippers. (a) Any shipper that has knowledge that the shipper's vessel will be used to import fireworks or articles pyrotechnic into the State or to transport fireworks or articles pyrotechnic between counties shall notify the fire department of the county to which the shipment is destined, before the departure date, as to whether the shipment will be distributed from: (1) Pier to pier; (2) Pier to warehouse or storage facility; or (3) Pier to redistribution. (b) At the time shipping is booked, the shipper shall notify the applicable county fire department in writing of the shipment's expected landing date. (c) The vessel containing the shipment shall be subject to the jurisdiction of the fire department of the county in which the vessel has landed. The county fire department may enter the vessel for the purpose of inspecting any shipment declared on the shipping manifest as fireworks or articles pyrotechnic." SECTION 3. New statutory material is underscored. SECTION 4. This Act shall take effect on July 1, 2050.
