43	43	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47	47	SECTION 1. (a) The auditor shall conduct a financial audit of the deposit beverage container program and the deposit beverage container deposit special fund. The financial audit shall include the following: (1) A review of all expenditures from the deposit beverage container deposit special fund; (2) Whether a sufficient nexus exists between the deposit beverage container program and expenditures from the deposit beverage container deposit special fund; and (3) Whether the department of health's expenditures from the deposit beverage container deposit special fund comply with all applicable laws. (b) The auditor shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2023. SECTION 2. This Act shall take effect upon its approval. INTRODUCED BY: _____________________________
