4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 SECTION 1. Section 200-12.5, Hawaii Revised Statutes, is amended to read as follows: "[[]§200-12.5[]] Native Hawaiian sailing canoes; education. (a) In all state small boat harbors, the department shall accommodate the mooring of a native Hawaiian [canoes] sailing canoe owned or leased by a nonprofit corporation, association, or organization[, or other duly chartered entity] that operates the native Hawaiian [canoes for] sailing canoe for research or educational purposes. If the native Hawaiian sailing canoe is being leased, the lessor must also be a nonprofit corporation, association, or organization. (b) Unless approved in writing by the chairperson or the chairperson's duly authorized representative, any native Hawaiian sailing canoe accommodated under subsection (a) shall not be allowed to moor for more than a cumulative period of thirty calendar days in a one hundred eighty calendar day period at each small boat harbor. [(b)] (c) Any owner or lessee of a native Hawaiian sailing canoe accommodated under subsection (a) shall submit to the department an annual report describing how the research or educational activities that were conducted during the previous year used, involved, or focused on the native Hawaiian sailing canoe. The report shall include: (1) A description of each research or educational activity; (2) The date of each research or educational activity; and (3) The number of participants in each research or educational activity. (d) Nothing in this section shall be construed to allow an owner or lessee of a native Hawaiian sailing canoe accommodated under subsection (a) to obtain priority for a mooring over a mooring permit applicant who is on the waitlist for the applicable small boat harbor. (e) For purposes of this section, "native Hawaiian sailing canoe" means a double-hulled, non-motorized sailing vessel greater than sixty feet in length. [(c)] (f) The chairperson may adopt rules pursuant to chapter 91 to implement this section." SECTION 2. Statutory material to be repealed is bracketed and stricken.
