37	37	requesting the department of transportation to ADOPT OR AMEND administrative rules to prohibit the installation or deployment of facilities that use fifth-generation cellular network technology, OR 5g TECHNOLOGY, near state airports and navigational equipment.

45	45	WHEREAS, fifth-generation cellular network technology, or 5G technology, is the latest iteration of cellular technology that is engineered to greatly increase the speed and responsiveness of wireless networks; and WHEREAS, the impending rollout of 5G technology poses a serious threat to aviation safety within the State; and WHEREAS, while 5G technology has been deployed near or around airports in foreign countries, the rollout of 5G technology in the United States is different because mobile phone companies in the United States rolling out 5G technology will be using a spectrum of radio waves with frequencies between 3.7 and 3.98 Gigahertz, known as the C-Band, whereas in other areas, such as Europe, 5G technology will be using a slower 3.4 to 3.8 Gigahertz range of spectrum; and WHEREAS, the aviation industry in the United States has expressed concerns that the spectrum of radio waves used by 5G technology is too close to the spectrum of 4.2 to 4.4 Gigahertz used by radar altimeters, which tell pilots how far they are from the ground; and WHEREAS, Hawaii is critically dependent upon air travel to support the visitor industry, which is the number one economic driver in the State; provide for the critical transportation of goods and services between islands for the economy and the basic quality of life that Hawaii citizens need in a multi-island state; and for business activities and necessary medical care; and WHEREAS, although the overall use of 5G technology and airplane activity are within the realm of the federal government, it is properly within the State's purview to regulate the installation of telecommunication technologies that may pose a hazard near or around state airports; and WHEREAS, due to the uncertainty of the effects of 5G technology on navigational equipment, the installation of 5G technology around state airports and other navigational equipment should be restricted; now, therefore, BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2022, the Senate concurring, that the Department of Transportation is requested to adopt or amend its administrative rules to prohibit wireless facilities and any modified or replacement utility poles used for the collocation of small wireless facilities that use fifth-generation cellular network technology from being installed or deployed near state airports and navigational equipment; and BE IT FURTHER RESOLVED that the Department of Transportation is requested to work with the Air Line Pilots Association, International, to determine the appropriate radius around a state airport or navigational equipment in which a wireless facility and any modified or replacement utility pole used for the collocation of small wireless facilities that use fifth-generation cellular network technology should be prohibited from being installed or deployed; and BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation and President of Air Line Pilots Association, International.
