4747 SECTION 1. The legislature finds that two chemicals contained in many sunscreens, oxybenzone and octinoxate, have significant harmful impacts on Hawaii's marine environment and residing ecosystems, including coral reefs that protect Hawaii's shoreline. Act 104, Session Laws of Hawaii 2018, bans the sale, offer of sale, and distribution in the State of any sunscreen, excluding facial cosmetics, that contains oxybenzone or octinoxate, without a prescription, beginning January 1, 2021. Visitors to Hawaii may be unaware of the harmful impacts of oxybenzone and octinoxate and may also be unfamiliar with sunscreen products that do not contain these chemicals. The purpose of this Act is to establish a two-year pilot program at Waikiki beach, Pupukea beach park, Wailea beach, and Honolua Bay beach in an effort to protect Hawaii's reefs and combat skin cancers. SECTION 2. The department of land and natural resources shall establish a two-year sunscreen dispenser pilot program to install sunscreen dispensers at Waikiki beach, Pupukea beach park, Wailea beach, and Honolua Bay beach to provide sunscreens that do not contain oxybenzone or octinoxate to visitors. Each dispenser shall include informational signage to educate visitors to the State about the harmful effects of oxybenzone and octinoxate sunscreen on coral reefs and to encourage visitors to the State to refrain from using sunscreen containing oxybenzone or octinoxate. SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2021-2022 and the same sum or so much thereof as may be necessary for fiscal year 2022-2023 for the sunscreen dispenser pilot program. The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act. SECTION 4. This Act shall take effect on July 1, 2021.
