4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. The legislature finds that government entities often experience difficulty attracting interested and qualified bidders to provide concession services on public property. One reason for the lack of bidders is the law that restricts how government entities may inform the public of available concession spaces. The legislature further finds that allowing concession contracts to be advertised through print or online notifications will expand the reach of those advertisements and encourage more competition among bidders, generate greater interest in concession services, and help capitalize sources of revenue. The purpose of this Act is to amend the requirements for the advertising of concession contracts on public property. SECTION 2. Section 102-4, Hawaii Revised Statutes, is amended to read as follows: "§102-4 Advertisement for bids. [Public notice] Advertisement of a call for bids shall be made either by: (1) Newspaper publication on not less than three different days statewide, with respect to any state agency, or county-wide within the particular county with respect to any county or county agency[.]; or (2) Online advertisement on the awarding government agency's website; provided that the online advertisement shall remain posted until the due date for bids has passed." SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored. SECTION 4. This Act shall take effect on July 1, 2050.
