47	47	SECTION 1. The legislature finds that although many appliances, such as refrigerators, dishwashers, and commercial air conditioners, are regulated by national appliance efficiency standards, states can decrease energy use, save consumers and businesses money, and reduce greenhouse gases and other pollutants by adopting state-level appliance efficiency standards for appliances that are not regulated by national standards. Since the enactment of Act 141, Session Laws of Hawaii 2019, (Act 141), which created minimum appliance efficiency standards for computers and computer monitors, faucets, high color rendering index fluorescent lamps, showerheads, and spray sprinkler bodies, other states have adopted efficiency standards for more appliances. According to research from the Appliance Standard Awareness Project, a steering committee that includes representatives from the environmental community, consumer groups, utilities, and state government, Hawaii should adopt efficiency standards for air purifiers, portable air conditioners, residential ventilating fans, portable electric spas, and uninterruptable power supplies as it would result in substantial savings for the State. Accordingly, the purpose of this Act is to require the department of business, economic development, and tourism to adopt minimum appliance efficiency standards for air purifiers, portable air conditioners, residential ventilating fans, portable electric spas, and uninterruptable power supplies sold or installed in the State that are substantially equivalent to existing appliance efficiency standards established by various states and the federal government. SECTION 2. Section 196-81, Hawaii Revised Statutes, is amended by adding five new definitions to be appropriately inserted and to read as follows: ""Air purifier" means an electric, cord-connected, portable appliance with the primary function of removing particulate matter from the air and which can be moved from room to room. "Portable air conditioner" means a portable encased assembly, other than a packaged terminal air conditioner, room air conditioner, or dehumidifier, that delivers cooled, conditioned air to an enclosed space, and is powered by single-phase electric current. It includes a source of refrigeration and may include additional means for air circulation and heating. "Portable electric spa" means a factory-built electric spa or hot tub, which may include any combination of integral controls, water heating, or water circulating equipment. "Residential ventilating fan" means a ceiling or wall-mounted in-line fan, designed to be used in a bathroom or utility room for the purpose of moving air from inside the building to the outdoors. "Uninterruptable power supply" means a battery charger consisting of a number of convertors, switches, and energy storage devices such as batteries, constituting a power system for maintaining continuity of load power in case of input power failure." SECTION 3. Section 196-84, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows: "(a) Appliance efficiency standards are established under this part for the following appliances, if standards for these appliances are not preempted by federal law: (1) Air purifiers; [(1)] (2) Computers and computer monitors; [(2)] (3) Faucets; [(3)] (4) High color rendering index fluorescent lamps; (5) Portable air conditioners; (6) Portable electric spas; (7) Residential ventilating fans; [(4)] (8) Showerheads; [and] [(5)] (9) Spray sprinkler bodies[.]; and (10) Uninterruptable power supplies." SECTION 4. Section 196-85, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows: "(a) The following minimum efficiency standards shall apply to products listed or incorporated in section 196-84: (1) Air purifiers shall meet the requirements set forth in the ENERGY STAR Program Requirements Product Specification for Room Air Cleaners, Version 2.0; [(1)] (2) Computers and computer monitors shall meet the requirements set forth in California Code of Regulations, Title 20, Section 1605.3, as amended; [(2)] (3) Faucets shall meet the minimum efficiency standards set forth in California Code of Regulations, Title 20, Section 1605.1, as amended; [(3)] (4) High color rendering index fluorescent lamps shall meet the minimum efficacy requirements contained in Section 430.32(n)(4) of Title 10 of the Code of Federal Regulations as in effect on January 3, 2017, as measured in accordance with Appendix R to Subpart B of Part 430 of Title 10 of the Code of Federal Regulations"Uniform Test Method for Measuring Average Lamp Efficacy (LE), Color Rendering Index (CRI), and Correlated Color Temperature (CCT) of Electric Lamps"as amended; (5) Portable air conditioners shall meet the requirements set forth in California Code of Regulations, Title 20, Section 1605.3, as amended; (6) Portable electric spas shall meet the requirements set forth in California Code of Regulations, Title 20, Section 1605.3, as amended; (7) Residential ventilating fans shall meet the requirements set forth in the ENERGY STAR Program Requirements Product Specification for Residential Ventilating Fans, Version 4.1; [(4)] (8) Showerheads shall meet the minimum efficiency standards set forth in California Code of Regulations, Title 20, Section 1605.1, as amended; [and] [(5)] (9) Spray sprinkler bodies that are not specifically excluded from the scope of the Environmental Protection Agency's WaterSense Specification for Spray Sprinkler Bodies, Version 1.0, shall include an integral pressure regulator and shall meet the water efficiency and performance criteria and other requirements of that specification, as amended[.]; and (10) Uninterruptable power supplies that use a National Electrical Manufacturer Association 1-15P or 5-15P input plug and have an alternating current output shall have an average load-adjusted efficiency that meets or exceed the values shown to be codified under Section 430.32(z)(3) of Title 10 of the Code of Federal Regulations and set forth on pages 193-194 of the final rule. Compliance with these requirements shall be measured in accordance with Title 10, Part 430, Subpart B, Appendix Y of the Code of Federal Regulations, entitled "Uniform Test Method for Measuring the Energy Consumption of Battery Chargers," as in effect on January 11, 2017." SECTION 5. Section 196-86, Hawaii Revised Statutes, is amended to read as follows: "[[]§196-86[]] Implementation. (a) On or after January 1, 2021, no new computer or computer monitor, faucet, high color rendering index fluorescent lamp, showerhead, or spray sprinkler body may be sold or offered for sale, lease, or rent in the State unless the efficiency of the new product meets or exceeds the efficiency standards provided in section 196-85. (b) On or after January 1, 2024, no new air purifier, portable air conditioner, residential ventilating fan, portable electric spa, and uninterruptable power supply may be sold or offered for sale, lease, or rent in the State unless the efficiency of the new product meets or exceeds the efficiency standards provided in section 196-85. [(b)] (c) One year after the date upon which the sale or offering for sale of certain products becomes subject to the requirements of [subsection (a),] subsections (a) and (b), no such products may be installed for compensation in the State unless the efficiency of the new product meets or exceeds the efficiency standards provided in section 196-85." SECTION 6. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date. SECTION 7. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable. SECTION 8. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored. SECTION 9. This Act shall take effect upon its approval. The legislature finds that although many appliances, such as refrigerators, dishwashers, and commercial air conditioners, are regulated by national appliance efficiency standards, states can decrease energy use, save consumers and businesses money, and reduce greenhouse gases and other pollutants by adopting state-level appliance efficiency standards for appliances that are not regulated by national standards. Since the enactment of Act 141, Session Laws of Hawaii 2019, (Act 141), which created minimum appliance efficiency standards for computers and computer monitors, faucets, high color rendering index fluorescent lamps, showerheads, and spray sprinkler bodies, other states have adopted efficiency standards for more appliances. According to research from the Appliance Standard Awareness Project, a steering committee that includes representatives from the environmental community, consumer groups, utilities, and state government, Hawaii should adopt efficiency standards for air purifiers, portable air conditioners, residential ventilating fans, portable electric spas, and uninterruptable power supplies as it would result in substantial savings for the State.

51	51	Accordingly, the purpose of this Act is to require the department of business, economic development, and tourism to adopt minimum appliance efficiency standards for air purifiers, portable air conditioners, residential ventilating fans, portable electric spas, and uninterruptable power supplies sold or installed in the State that are substantially equivalent to existing appliance efficiency standards established by various states and the federal government.
