4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. The purpose of this Act is to ensure the stability of services provided to the residents of Hawaii by various homeless programs administered by the department of human services through consistent and continuous funding of homeless related programs. SECTION 2. There is appropriated out of the funds received by the State of Hawaii from the American Rescue Plan Act, Public Law 117‑2, Section 9901, for the department of human services the sum of $ ; provided that of the American Rescue Plan Act appropriation for the department of human services: (1) The sum of $ or so much thereof as may be necessary for fiscal year 2022-2023 shall be expended for homes services (HMS224), and shall be allocated as follows: (A) For family assessment centers, $ or so much thereof that may be necessary for fiscal year 2022-2023; (B) For the housing first program, $ or so much thereof that may be necessary for fiscal year 2022-2023; (C) For the homeless rapid re-housing program, $ or so much thereof that may be necessary for fiscal year 2022-2023; (D) For the homeless outreach program, $ or so much thereof that may be necessary for fiscal year 2022-2023; (E) For stored property and debris removal services, $ or so much thereof that may be necessary for fiscal year 2022-2023; (2) The sum of $ or so much thereof as may be necessary for fiscal year 2022-2023 shall be expended for rental assistance services (HMS222); and (3) The sum of $ or so much thereof as may be necessary for fiscal year 2022-2023 shall be expended for general assistance payments (HMS224); provided that any funds not expended for these purposes shall lapse. SECTION 3. Each year, the department of human services shall make all efforts available to fully fund all programs relating to homelessness that are administered by the department. SECTION 4. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable. SECTION 5. This Act shall take effect on July 1, 2022.
