4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. This Act is recommended by the governor for immediate passage in accordance with article VII, section 9 of the Constitution of the State of Hawaii. SECTION 2. The legislature finds that on July 1, 2005, the department of education and the department of accounting and general services entered into a memorandum of understanding to supplement the transfer of resources from the department of accounting and general services to the department of education pursuant to Act 51, Session Laws of Hawaii 2004. The memorandum of understanding included a provision for the department of education to use facilities at Shafter Flats to house its maintenance base yard. However, the economic downturn in 2020 and the limited amount of available resources resulted in a request made by the department of accounting and general services on June 4, 2021, to have the department of education relocate from the Shafter Flats facility by October of 2021. The legislature further finds that since June of 2021, the department of education has been looking for a new facility to house its maintenance base yard. A new facility is vital for needed warehouse and storage space to allow the department of education to continue to service all of its facilities, including two hundred fifty-seven public schools, thirty-seven charter schools, and nearly one hundred eighty thousand students statewide. The purpose of this Act is to authorize the issuance of general obligation bonds for a department of education maintenance base yard. SECTION 3. The director of finance is authorized to issue general obligation bonds in the sum of $ or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2021-2022 for the purpose of securing a maintenance base yard for the department of education. The sum appropriated shall be expended by the department of education. SECTION 4. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2024, shall lapse as of that date. SECTION 5. This Act shall take effect on July 1, 2051.
