The legislature finds that students who participate in interscholastic athletic activities experience a variety of benefits including increased academic success, improved physical health, improved leadership and teamwork abilities, a greater sense of accountability and responsibility, improved concentration, higher self-esteem and self-confidence, reduced likelihood of using drugs, lower likelihood of dropping out of school, and a reduced suicide rate. Student-athletes often spend more time with their coaches than their teachers, and coaches can instill important life skills on youth, especially youth that do not readily thrive in an academic setting. The purpose of this Act is to designate existing interscholastic sports as co-curricular activities, instead of extracurricular activities, so that they are considered to have an essential status within the department of education. SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part I, subpart B, to be appropriately designated and to read as follows: "§302A- Co-curricular activities; sports. (a) Any sport recognized by the department shall be considered a co‑curricular activity, including air riflery, baseball, basketball, bowling, canoe paddling, cheerleading, cross country running, diving, football, golf, judo, soccer, soft tennis, softball, surfing, swimming, tennis, track and field, volleyball, water polo, and wrestling. (b) The department shall adopt rules pursuant to chapter 91 to implement sports as co-curricular activities under this section." SECTION 3. Section 302A-101, Hawaii Revised Statutes, is amended by adding four new definitions to be appropriately inserted and to read as follows: ""Curricular activity" means any activity that is a part of the curriculum. "Curriculum" means a plan that outlines what students shall be taught and includes all the courses offered or all the courses offered in a particular area of study. "Co-curricular activity" means any activity that is outside of, but usually complements, the curriculum. "Extracurricular activity" means any school-based activity that is not tied to the curriculum." SECTION 4. The department of education shall study and estimate the cost, if any, of implementing sports as co-curricular activities. The department of education shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2023. SECTION 5. New statutory material is underscored. SECTION 6. This Act shall take effect on July 1, 2050. |
