THE SENATE S.R. NO. 69 THIRTY-FIRST LEGISLATURE, 2022 STATE OF HAWAII THE SENATE S.R. NO. 69 THIRTY-FIRST LEGISLATURE, 2022 STATE OF HAWAII SENATE RESOLUTION Requesting the board of agriculture to prohibit unapproved residential use of farm dwellings in agricultural parks. WHEREAS, agricultural parks are an essential component of the State's agricultural industry; and WHEREAS, the primary purpose of agricultural parks is for agricultural production, not residential use; and WHEREAS, residential use of farm dwellings on agricultural parks can produce noise, dust, and other nuisances that disrupt nearby communities; and WHEREAS, there have been numerous complaints from communities in or near agricultural parks regarding dust, noise, and other nuisances from the residential use of agricultural parks; and WHEREAS, a prohibition on certain residential uses of agricultural parks would mitigate or eliminate the production of noise, dust, and other nuisances in agricultural parks; now, therefore, BE IT RESOLVED by the Senate of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2022, that the Board of Agriculture is requested to establish a prohibition on unapproved residential uses of farm dwellings in agricultural parks; and BE IT FURTHER RESOLVED that the Board of Agriculture is requested to prepare and submit a report of its findings and recommendations, including actions taken, progress made, and any proposed legislation to the Legislature no later than thirty days prior to the convening of the Regular Session of 2023; and BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Chairperson of the Board of Agriculture.
