4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. Chapter 264, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows: "§264- Traffic control; state and county projects; traffic flow and mitigation. The department of transportation shall authorize all state and county traffic project contractors to make changes, as necessary, to traffic flow and safety or mitigation efforts during periods of severe traffic; provided that contractors shall not charge for additional changes to traffic flow and safety or mitigation efforts. The department of transportation shall make the final determination to any changes made to traffic flow and mitigation efforts a state or county traffic project." SECTION 2. New statutory material is underscored. SECTION 3. This Act shall take effect on June 30, 3000.
