43	43	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47	47	SECTION 1. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 to provide back payments in the amount of $2,500 per medicaid- eligible client under the care of the following care homes for each year during the period between July 1, 2009, to June 30, 2023: (1) Community care foster family homes issued a certificate of approval pursuant section 321-483, Hawaii Revised Statutes; (2) Adult residential care homes type I licensed pursuant to section 321-15.6, Hawaii Revised Statutes; (3) Expanded adult residential care homes licensed pursuant to section 321-15.62, Hawaii Revised Statutes; and (4) Developmental disabilities domiciliary homes licensed pursuant to section 321-15.9, Hawaii Revised Statutes; provided that back payments for medicaid-eligible clients who were housed less than a year shall be prorated; provided further that, to claim this back payment, applicable care home operators shall provide historical records of the medicaid-eligible clients under their care, at the request of the department of human services, along with any other information the department deems necessary to verify eligibility for back payments; provided further that back payments made pursuant to this Act shall be made in monthly installments over the course of twelve months or in a single lump sum, at the request of the applicable care home operator. The sum appropriated shall be expended by the department of human services for the purposes of this Act. SECTION 2. This Act shall take effect on July 1, 2023.
