4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows: "§200- Registration required for rental kayaks; affixing identification number; fees. (a) Beginning January 1, 2024, no person shall provide or offer to provide a rental kayak to the public, unless the rental kayak is registered and numbered with the department on an annual basis in accordance with rules adopted by the department before the rental kayak's use or operation on or in the waters of the State. (b) Beginning January 1, 2024, every rental kayak provided or offered to the public shall have the identification number affixed to the rental kayak. (c) The department shall establish reasonable fees for the initial registration and annual renewal registration in accordance with rules adopted pursuant to chapter 91. (d) For purposes of this section, "rental kayak" means a kayak that is rented or leased or offered for rent or lease in the State for a period of one month or less." SECTION 2. Section 200-34, Hawaii Revised Statutes, is amended to read as follows: "§200-34 Disposition of revenues. All fees and penalties collected pursuant to sections 200-10, 200-14, 200-14.5, 200-25, and 200-32, and all fees and penalties established by rules adopted pursuant to sections 200-4 [and], 200-24, and 200- , shall be deposited in the boating special fund." SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored. SECTION 4. This Act shall take effect on June 30, 3000.
