Chapter 9, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows: "§9- Art in private places and performing arts committee. (a) There is established an art in private places and performing arts committee to be placed within the state foundation on culture and the arts for administrative purposes. (b) The art in private places and performing arts committee shall comprise the following members: (1) The executive director of the state foundation on culture and the arts, or the executive director's designee, who shall serve as chairperson; (2) The chairpersons of the senate and house of representatives standing committees whose purview is culture and the arts; and (3) Two members who represent the performing arts community, who shall be selected by the chairperson and invited to participate. (c) The art in private places and performing arts committee shall establish the art in private places pilot program and performing arts pilot program, under which the committee shall: (1) Oversee the implementation of the art in private places pilot program; (2) Solicit proposals for performing arts grants; (3) Review grant proposals and select proposals appropriate for funding; and (4) Evaluate outcomes of grant proposals. (d) The art in private places and performing arts committee shall submit annual reports of: (1) The status of the art in private places pilot program and the revenue generated from the program; and (2) Funded performing arts proposals and the outcomes of each event, to the legislature no later than twenty days prior to the convening of each regular session beginning with the regular session of 2024. (e) For the purposes of this section, "private places" means non-state owned, publicly accessible areas and city and county buildings. §9- Performing arts special account. There is established in the state treasury the performing arts special account into which shall be deposited: (1) Revenues from the performing arts pilot program; (2) Revenues from the art in private places pilot program; (3) Gifts, grants, and other funds for performing arts accepted by the foundation; (4) Appropriations by the legislature to the performing arts special account; and (5) All interest and revenues or receipts derived by the foundation from performing arts events, including: (A) Rents, fees, and charges for the use of facilities; (B) Concession agreements and other use agreements; and (C) Revenues generated from agreements to record performances negotiated by the foundation. Moneys in the account shall be used for coordinating, planning, promoting, marketing, and executing performing arts events; provided that not more than per cent shall be used for administrative expenses." SECTION 2. Chapter 9, Hawaii Revised Statutes, is amended by amending the title of part III to read as follows: "[[]PART III.[]] ART IN PUBLIC PLACES AND RELOCATABLE WORKS of [[]ART[]] PROGRAMS, PERFORMING ARTS, AND STATE ART MUSEUM" SECTION 3. Section 9-21, Hawaii Revised Statutes, is amended to read as follows: "[[]§9-21[]] Purpose. The foundation shall administer the art in public places and relocatable works of art programs, pursuant to section 103-8.5, the performing arts pilot program, and the state art museum to achieve the following purposes: (1) Replace in public state buildings the natural beauty displaced in construction with works of art expressive of the State's cultural, creative, and traditional arts of its various ethnic groups; (2) Support, promote, and recognize excellence of the State's diverse cultural, creative, and traditional artists; [and] (3) Create, display, and maintain in public places and the state art museum a collection of works of art that: (A) Represents the diversity and excellence of the State's artistic expression; and (B) Provides to all the citizens of the State the fullest possible access to the highest quality aesthetic and educational experiences available[.]; and (4) Coordinate, plan, promote, market, and execute the performing arts pilot program. As used in this section, "performing arts" include arts or skills that are intended to be performed before an audience including, dance, singing, musical performances, and theatre." SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 to the state foundation on culture and the arts for: (1) Establishing and implementing the art in private places and performing arts pilot programs; and (2) Establishing one full-time equivalent (1.0 FTE) permanent position to oversee the pilot programs established by this Act. The sums appropriated shall be expended by the state foundation on culture and the arts for the purposes of this Act. SECTION 5. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored. SECTION 6. This Act shall take effect on June 30, 3000. |
