4747 SECTION 1. Chapter 322, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows: "§322- Feeding of feral chickens; prohibited. (a) No person shall knowingly feed or attempt to feed any feral chicken, regardless of whether the feeding occurs on public or private property. (b) For purposes of this section, "feral chicken" means any live chicken that is: (1) Not in captivity; and (2) Not owned by any individual or entity. (c) A person who violates this section shall pay a $500 civil fine for each feral chicken the person fed or attempted to feed. (d) The department of health shall enforce this section, regardless of whether the department finds that the person's feeding or attempt to feed a feral chicken creates a nuisance that is dangerous or injurious to health, as described in section 322-1. (e) The police department of the county in which a violation of this section occurs may assist the department of health in the enforcement of this section through the issuance of a citation to the violator." SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date. SECTION 3.
