4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows: "§302A- Opioid antagonist; classroom; training. (a) Each department classroom shall be equipped with at least one opioid antagonist. (b) The department shall provide or coordinate with any public or private entity to provide training to department employees on: (1) Opioid-related drug overdose prevention, recognition, and response; and (2) Opioid antagonist administration. The board shall establish standards and frequency for the training. (c) An employee of the department who, acting in good faith and with reasonable care, administers an opioid antagonist to a student whom the employee believes to be suffering an opioid-related drug overdose shall be immune from criminal prosecution, sanction under any professional licensing law, and civil liability for acts or omissions resulting from the administration. (d) As used in this section: "Opioid antagonist" has the same meaning as in section 329E‑1. "Opioid-related drug overdose" has the same meaning as in section 329E‑1." SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the purchase and placement of an opioid antagonist in each department of education classroom and training of teachers and other department of education employees on opioid‑related drug overdose prevention, recognition, and response and opioid antagonist administration. The sums appropriated shall be expended by the department of education for the purposes of this Act. SECTION 3. New statutory material is underscored. SECTION 4.
