4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XIV to be appropriately designated and to read as follows: "§291C- Operating motorcycles on the designated shoulder. (a) All motorcycles are entitled to full use of the shoulder on interstate highways as authorized by the department of transportation; provided that the shoulder is a minimum of three-feet-wide and the operator of a motorcycle shall use emergency flashers while traveling on the shoulder. (b) The department of transportation shall create traffic control devices to designate shoulder usage for motorcycles during peak traffic hours." SECTION 2. New statutory material is underscored. SECTION 3. This Act shall take effect on July 1, 2050.
