43	43		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47		-	SECTION 1. Section 302A-1706, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows: "(c) The school facilities special fund shall be administered by the authority and used to fund any school development, planning, or construction project within the jurisdiction of the authority. Amounts up to the balance of moneys available in the school facilities special fund may be appropriated from the fund each fiscal year." SECTION 2. Act 257, Session Laws of Hawaii 2022, is amended by amending sections 1 and 2 to read as follows: "SECTION 1. There is appropriated out of the general revenues of the State of Hawaii the sum of [$200,000,000~~] $~~ or so much thereof as may be necessary for fiscal year [2022-2023~~] 2023-2024~~ to be deposited into the school facilities special fund. SECTION 2. There is appropriated out of the school facilities special fund the sum of $ or so much thereof as may be necessary for fiscal year 2023~~-2024~~ for the school facilities authority to expand access to pre-kindergarten to eligible children of the State. The school facilities authority may expend the moneys appropriated in this section on: (1) The construction of new school facilities; (2) The renovation, improvement, and expansion of existing school facilities to increase pre-kindergarten student capacity; and (3) Any other costs the school facilities authority deems appropriate to increase pre-kindergarten student capacity within the State. The sum appropriated shall be expended by the school facilities authority for the purposes of this Act[; provided that the appropriation authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided further that all moneys from the appropriation unencumbered as of June 30, 2024, shall lapse as of that date]. SECTION [2.] 3. This Act shall take effect on July 1, 2022." SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored. SECTION 4. This Act shall take effect ~~on July 1, 2050~~.
