4141 WHEREAS, the State has a duty to protect the people; and WHEREAS, a number of state residents in certain areas of West Oahu have been the victims of misdemeanors; and WHEREAS, legislation introduced during the Regular Session of 2023 proposes to authorize the imposition of a sentence of a probationary term of geographic restriction upon a convicted misdemeanant if the misdemeanant has two prior misdemeanor convictions and each conviction was the result of an act that occurred within Ewa Beach, Kapolei, or Waianae; and WHEREAS, the imposition of the proposed geographic restrictions may have a deterrent effect; now, therefore, BE IT RESOLVED by the Senate of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2023, that the Judiciary is requested to conduct a study of the potential impacts of Senate Bill No. 619, Regular Session of 2023; and BE IT FURTHER RESOLVED that in conducting the study, the Judiciary is requested to: (1) Assess the bill's potential fiscal impacts on the Judiciary, county prosecutors, Office of the Public Defender, and other governmental agencies; (2) Assess the bill's potential impact on crime rates; and (3) Examine other relevant issues, as appropriate; and BE IT FURTHER RESOLVED that the Judiciary is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2024; and BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chief Justice of the Supreme Court of Hawaii and the Administrative Director of the Courts.
