A BILL FOR AN ACT

 

 

relating to the department of human services.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

      SECTION 1.  (a)  The med-QUEST division of the department of human services shall adopt rules pursuant to chapter 91, Hawaii Revised Statutes, to authorize reimbursements for remote ultrasound procedures and remote fetal nonstress tests.      (b)  The rules adopted pursuant to subsection (a) shall require that:      (1)  Each remote ultrasound procedure or remote fetal nonstress test be reimbursed using the same current procedural terminology, or CPT, codes as if the procedure was performed in the clinic and the same standard of care is met; provided that any healthcare provider offering remote ultrasound or remote nonstress tests may also use other appropriate CPT codes for home visiting services, telehealth, or other remote services;      (2)  Each applicable healthcare provider maintains the same standard of care that the provider would otherwise exercise for an in-person ultrasound procedure or fetal nonstress test;      (3)  Each remote ultrasound procedure or remote fetal nonstress test only be reimbursable if the applicable healthcare provider uses digital technology:           (A)  To collect medical and other forms of health data from the patient and electronically and securely transmits that information to another healthcare provider in a different location for interpretation and to provide recommendations;           (B)  That is compliant with the Health Insurance Portability and Accountability Act of 1996, P.L. 104-191, as amended; and           (C)  That is approved by the United States Food and Drug Administration; and      (4)  Each fetal nonstress test be reimbursed as an in‑clinic fetal nonstress test with a place of service modifier for home (12) using remote monitoring solutions that are approved by the United States Food and Drug Administration for on‑label use for monitoring fetal heart rate, maternal heart rate, and uterine activity.      SECTION 2.  This Act shall take effect upon its approval.      INTRODUCED BY:   _____________________________
