4747 SECTION 1. Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to part VIII to be appropriately designated and to read as follows: "§346‑ Demonstration projects; requirements; modifications. (a) A child care facility may establish a demonstration project for a specific purpose, or set of purposes, upon receiving written approval from the department. (b) The child care facility shall submit a written proposal to the department indicating the following: (1) Purpose of the project; (2) Description of the project; (3) Length of the project; (4) Specific child care rules that shall be exempted by the project; and (5) Justification for the proposed exemptions. (c) The persons responsible for the project, or their designee, shall appear in person to discuss the proposal with the department, or the department's designee, upon request by the department. (d) A demonstration project that has been approved in writing by the department shall include, at the time of the project's approval: (1) The words "licensed demonstration project" in the name or description; and (2) Proof that the project is, at all times, in compliance with the child care rules, except as specifically exempted or modified in the department's written approval; and (e) Within the last quarter of the time specified for the demonstration project, the child care facility shall submit a written report to the department, which shall include: (1) Developments, findings, recommendations, and suggestions for further study; and (2) Any proposed recommendations for changing or modifying child care rules under the demonstration project, along with justifications for the change or modification. (f) Proposed demonstration programs disapproved or discontinued by the department shall not use the words "demonstration project" in the identifying title, logo, or material." SECTION 2.
