4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. This Act is recommended by the governor for immediate passage in accordance with section 9 of article VII of the Constitution of the State of Hawaii. SECTION 2. In accordance with section 9 of article VII of the Constitution of the State of Hawaii and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the general fund expenditure ceiling for fiscal year 2023-2024 has already been exceeded by $1,005,342,735 or 9.4 per cent. The appropriation contained in this Act will cause the state general fund expenditure ceiling for fiscal year 2023-2024 to be further exceeded by $ or per cent. This declaration considers the additional general fund appropriations authorized for fiscal year 2023-2024 in this Act only. The reasons for exceeding the general fund expenditure ceiling are that: (1) The appropriations made in this Act are necessary to serve the public interest; and (2) The appropriations made in this Act meet the needs addressed by this Act. SECTION 3. The legislature finds that several instances of asbestos disturbance have been reported at the department of health's main offices at Kinau Hale, located at 1250 Punchbowl Street, Honolulu, Oahu. Ambient air sampling by a private environmental and industrial health and safety vendor throughout the building found that any fibers in the air are at a level below the minimum detection level. These minimum detection levels are lower than the U.S. Occupational Safety and Health Administration's actionable threshold of 0.1 fibers/cc, as well as the more stringent industry standard for clearance level of 0.01 fibers/cc. Although testing confirms that the air in Kinau Hale is safe, these incidents are occurring more often, and the building's overall condition is poor and has been steadily deteriorating. A major incident, such as heavy rains causing massive roof leaks, could turn the building into a localized public health emergency. The legislature further finds that Kinau Hale's location on a large parcel adjacent to private medical facilities would make it suitable for mixed-use redevelopment, including the department's offices and private clinical facilities in a public-private partnership. Therefore, the purpose of this Act is to make an emergency appropriation to the department of health for emergency asbestos remediation and temporary relocation of the main offices of the department of health, if necessary, and preliminary planning for redevelopment of the site. SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 for emergency asbestos remediation; moving costs and other expenses associated with temporarily relocating the department of health's offices at 1250 Punchbowl Street, Honolulu, Oahu, if necessary; and preliminary planning for redevelopment of the site. The sum appropriated shall be expended by the department of health for the purposes of the Act. SECTION 5. This Act shall take effect on July 1, 3000.
